Standard-setting represents one of the main constitutional functions of UNESCO and an important tool for realizing the goals for which the Organization was created. In addition to conventions and recommendations, the declarations adopted by the General Conference promulgate principles and norms intended to inspire the action of Member States in specific fields of activity. This first of a two-volume work on Standard-setting in UNESCO contains the essays presented at a symposium held on the occasion of its sixtieth anniversary. Topics addressed in Normative Action in Education, Science and Culture include methods of elaboration and implementation; constitutional objectives and legal commitments; international collaboration; and impact. NATO's air operation against Yugoslavia, undertaken with a view to helping the Kosovo Albanians resist genocide and ethnic cleansing, confronted the international community with a bitter dilemma. In Europe, the choice either to tolerate massive violations of human rights or to infringe the principle of non-use of force, given the absence of explicit authorization by the Security Council, was a challenge never before encountered since the new world order was ushered in by the Charter of the United Nations. This book, a collection of legal essays which emerged from a meeting of members of the French, German, and Polish societies of international law, not only attempts to analyze the Kosovo war from the viewpoint of humanitarian intervention based on the failure of the Rambouillet conference, but also intends to provide an overall picture of the responsibilities incumbent on the international community. Starting with the lifting of Kosovo's autonomy by the Yugoslav federal authorities in 1989/90, it follows the tragic events step by step. Not only are the crimes committed by Yugoslav military units and police as well as by the Kosovo Liberation Army listed in specific detail, an inquiry is also made into NATO's compliance with the applicable standards of humanitarian law. The book concludes with an examination of the future of the province in light of Security Council resolution 1244 of 1999 and the Stability Pact adopted to ensure economic recovery of the entire region.

The International Law Commission was established in 1947 with a view to carrying out the responsibility of the General Assembly, under article 13(1)(a) of the Charter of the United Nations, to "initiate studies and make recommendations for the purpose of ... encouraging the progressive development of international law and its codification." Since its first session in 1949, the Commission has considered a wide-range of topics of international law and made a number of proposals for its codification and progressive development, some of which have served as the basis for the subsequent adoption of major multilateral treaties. The Yearbook of the International Law Commission contains the official records of the Commission and is an indispensable tool for the preservation of the legislative history of the documents emanating from the Commission, as well as for the teaching, study, dissemination and wider appreciation of the efforts undertaken by the Commission in the progressive development of international law and its codification. Volume I reproduces the summary records of the Commission's annual sessions.

Immigration Regulation In Federal States written by Sasha Baglay and has been published by Springer Science & Business Media this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-03-18 with Social Science categories.

The book examines the phenomenon of immigration federalism: its main characteristics, why and how it has developed, its implications for immigration systems (in general) and non-citizens’ rights (in particular). The book introduces the reader to theoretical perspectives on immigration federalism through three sets of literature – federalism, governance and non-citizens’ rights – that provide a necessary framework for understanding immigration federalism’s multiple facets and impacts. It also offers an analysis of immigration federalism through case studies of six jurisdictions: Australia, Canada, Germany, Switzerland, the EU and the US. Despite increased sub-national activity in immigration regulation in several federal states, very little research has been dedicated so far to comparing how federal states deal with immigration federalism. Comparative studies on the human rights implications of immigration federalism have received even less attention. This book seeks to fill the gap in this area and is an important contribution to the field, providing the reader with a better understanding of the complex issues surrounding immigration federalism and its impact on non-citizens.
