La réforme de la biologie médicale constitue une avancée majeure dans l’organisation de notre système de santé. Initiée par le rapport Ballereau en 2008, formalisée par l’ordonnance n°2010-49 du 13 janvier 2010 et la loi n° 2013-442 du 30 mai 2013, cette réforme poursuit trois principaux objectifs : réaffirmer la médicalisation des examens de biologie, organiser la profession via un mécanisme progressif d’accréditation, lutter contre la financiarisation excessive du secteur. Tous les acteurs s’accordent sur l’intérêt d’une réforme qui, à terme, permettra de moderniser un secteur dont l’organisation datait de 1975. Le présent rapport, pris en application de l’article 145-7 du Règlement de l’Assemblée nationale, entend réinvestir ces trois principaux axes à la lumière des textes d’application. Les rapporteurs se félicitent de l’investissement de l’ensemble des acteurs pour la réussite de la réforme mais ils estiment nécessaire que le cap fixé soit maintenu. Au 31 décembre 2015, soit près de trois ans après l’adoption définitive de la loi du 30 mai 2013, les décrets les plus attendus n’ont toujours pas été publiés, retardant d’autant l’organisation de la profession. La mise en place de l’accréditation, qui constitue une démarche inédite en Europe, suscite des interrogations quant au respect des jalons fixés par le législateur. Enfin, s’agissant du volet relatif à la financiarisation, il est primordial de publier prochainement les mesures d’application, notamment celles liées aux sanctions administratives, afin d’assurer l’effectivité du contrôle exercé par les agences régionales de santé dans les territoires.
