Peter H Berle On Constitutional Theory written by Markus Kotzur and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018 with Constitutional law categories.

Peter Häberle, one of the most eminent constitutional lawyers in Germany and beyond, has devoted over four decades of academic work to one central idea: that processes of constitutionalization are cultural processes and their outcome, the constitution, thus qualifies as an emanation of culture itself. The volume introduces six seminal centrepieces of Häberle ́s constitutional cosmos to an English-speaking audience. His reflections on "Fundamental Rights in the Welfare State" introduced a "flexible dogmatic of human rights" according to which all human rights can be conceived social rights. "The open society of constitutional interpreters" and the classical piece on "Preambles in the text and context of constitutions" revolutionized constitutional interpretation theory. In his article on human dignity, Häberle paved the way for conceptualizing this notion as textual foundation of constitutional Democracies. The last two papers present the rationale for a cultural concept of constitutions and apply to the European plane, too. Get to know Peter Häberle as a scholar who wants to discover the world beyond positive law. Enjoy a fruitful journey of discovery!

For three days in November of 1981 Prime Minister Pierre Trudeau and the other First Ministers met in private in Ottawa to try and get a deal on a new constitution for Canada. No official minutes or recordings were made of their discussions. However, Dr. Howard Leeson, now a Professor of Political Science at the University of Regina, was then the Deputy Minister of Intergovernmental Affairs for Saskatchewan and sat in on the private meetings. He took extensive minutes of the actual discussions of the First Ministers and wrote comprehensive memos on other important meetings that happened away from the conference meetings themselves. Now for the first time these documents are being made public. Together they offer a rate insight into what really happened in these negotiation that produced a new constitution for Canada. In particular Dr. Leeson challenges the two orthodox views of patriation which ascribe much of the credit for the deal to Prime Minister Trudeau and the blame for the exclusion of Quebec on the provinces. Instead he argues that Trudeau actually had little influence at the end of the process and that the English-speaking Premiers were far more influential in the shape of the package than they have been given credit for. Between the morning of Wednesday, November 4, and the morning of Thursday, November 5, 1981, a fateful drama unfolded that changed Canada forever. In one last attempt to renew the constitution with the consent of the provinces, Prime Minister Pierre Elliott Trudeau met behind closed doors in Ottawa with the ten premiers. It was the culmination of more than five decades of constitutional wrangling, and has been called the most important conference since the Fathers of Confederation got together in Quebec City in 1864. Faced with the threat of Quebec independence, the ambitions of Western Canada, and the provinces’ demands for more power, Trudeau was embattled. But he was fiercely determined to make Canadians fully independent and to entrench a Charter of Rights and Freedoms. What happened that day still reverberates. It severed the last important link to Canada’s colonial past. It guaranteed individual liberty and minority rights in the future. It weakened the grip of the elites and gave ownership of the constitution to Canadians. But it came at a price. Quebec alone refused to sign the final deal. René Lévesque, its separatist premier, claimed he had been betrayed by his allies in the Gang of Eight. The legend of the "Night of the Long Knives" took hold, precipitating a series of events that came close to destroying the country. Thirty years later, author Ron Graham delivers a gripping account of the fractious debates and secret negotiations. He uses newly uncovered documents and the candid recollections of many of the key participants to create a vivid record of that momentous twenty-four hours. Authoritative and engaging, The Last Act is a remarkable combination of scholarly research and historical narrative.

"Some day the sun will shine and have not will be no more." These are the immortal words of Brian Peckford, who served as the third premier of Newfoundland, and leader of the Progressive Conservative Party from 1979 until his retirement in 1989. As one of Newfoundland's most committed and combative leaders, Mr. Peckford's clashes with the federal government--to wrest control of the province's natural resources--resulted in the groundbreaking Atlantic Accord of 1985, his greatest political triumph during the province's struggle for self-reliance in a post-Confederation era. This memoir begins with Mr. Peckford's formative years growing up in outport Newfoundland. It gives all due praise to personal heroes of his, from the seasoned fishermen of La Poile and Pilley's Island to experienced politicos such as Minister William Marshall and Prime Minister Brian Mulroney. The past, present, and his vision for the future of Newfoundland and Labrador are revealed here, as well as his insights on Constitution-making and the varicoloured political careers of juggernauts like Joey Smallwood, John Crosbie, and René Lévesque.
