Being Apart From Reasons written by Cláudio Jr. Michelon and has been published by Springer Science & Business Media this book supported file pdf, txt, epub, kindle and other format this book has been release on 2006-04-23 with Philosophy categories.

Being Apart from Reasons deals with the question of how we should go about using reasons to decide what to do. More particularly, the book presents objections to the most common response given by contemporary legal and political theorists to the moral complexity of decision-making in modern societies, namely: the attempt to release public agents from their argumentative burden by insulating a particular set of reasons from the general pool of reasons and assigning the former systematic priority over all other reasons. That strategy is apparent both in Rawls’ claim that reasons concerning the right are systematically prior to reasons concerning the good and in Raz’s claim that pre-emptive reasons are systematically prior to first-order reasons. The same strategy is also instantiated by certain arguments for the procedural value of law, such as Jeremy Waldron’s. In the book, each of those arguments for the insulation of reasons is objected to in order to defend the thesis the reasoning by public agents must always be as comprehensive as possible. The remaining chapters object to those arguments mentioned above which aim at justifying the exclusion of certain reasons from public agents' decision-making.

The principal advantages of giving written reasons for decisions are generally considered to be: • improving the quality of the decisions being made, • enhancing the fairness and transparency of the decision and the decision- making process, and • facilitating the exercise of any rights to have the decision reviewed.3 Improved Quality The actual process of setting out the reasons for a decision in [...] Also, the knowledge that the reasons will be scrutinized by the people directly affected by the decision (especially the "losing" party), and possibly others such as the public, the courts, professional colleagues or others in a particular 3 In the leading Canadian case on the obligation to give reasons, the Supreme Court of Canada gave a concise summary of how reasons can achieve all three of the [...] In Baker, the SCC set out the following five factors to be considered in determining the extent of the procedural fairness protections to which an individual is entitled: • the nature of the decision; • the nature of the specific legislative provision and of the statutory scheme as a whole under which the decision is made; • the importance of the decision to the individual affected; • the legitima [...] Further, the reasons given for the decision must be those of the decision-maker; if someone else makes the decision, or provides the reasons for it, the decision can be set aside by the court as giving rise to an apprehension of bias, or as offending the non-delegation rule.34 However, the courts have also recognized that while the SDM has the legal responsibility to make the ultimate decision, as [...] As the Ontario Court of Appeal stated, consultation with staff should be encouraged where it promotes the ultimate aim of the drafting process: to create a set of reasons that accurately and fully reflects the thought processes of the SDM.36 The test for whether such assistance is acceptable is whether it compromises either the fairness or the integrity of the decision-making process.37.

Reasoning And Decision Making written by Philip N. Johnson-Laird and has been published by Wiley-Blackwell this book supported file pdf, txt, epub, kindle and other format this book has been release on 1994-08-15 with Psychology categories.

This volume brings together two hitherto separate aspects of the psychology of thinking: how people reason, and how they make judgements and decisions. This exploration is timely for two major reasons. First, reasoning and decision making are increasingly examined in the role of reason in the construction of preferences, and students of deduction are examining the role of values and preferences in reasoning. Second, research in the two domains has revealed a striking parallel; human thinkers make radical departures from the canons of rationality - from formal logic in the case of reasoning, and from expected utility theory in the case of decision making. The two departures have forced social scientists to think again about the nature of human mentality. The contributors are all internationally known experts, and their chapters range over the nature of rationality, how individuals construct reasons for choices, how they are led astray by focusing on only certain aspects of situations, how they assess the strength of inductions, how they reach decisions on juries, and how their performance can be improved. Reasoning and Decision Making will be suitable for advanced undergraduate reading and beyond, and will be of interest to psychologists, decision theorists and philosophers.
