In seguito all’entrata in vigore della legge, 9/03/2022, n. 22, nel nostro ordinamento giuridico, recependo in parte quanto richiesto dalla Convenzione di Nicosia, ratificata in Italia con la legge, 21 gennaio 2022, n. 6, sono state inserite, in seno al codice penale, delle apposite norme incriminatrici - tra cui alcune di esse richiamano in buona parte quanto già preveduto dal codice dei beni culturali e del paesaggio - che introducono i reati contro il patrimonio culturale. Scopo del presente scritto è quello di esaminare siffatte disposizioni legislative al fine di comprendere in cosa consistono gli elementi costitutivi che connotano siffatti illeciti penali.

Si occupa degli NFT (non-fungibile token), certificati elettronici dotati di un codice criptato e della firma dell’artista che attesta l’unicità e la proprietà dell’opera. Tratta, altresì, in maniera approfondita i vari reati introdotti nel codice penale dalla legge n. 22 del 09 marzo 2022, con particolare riguardo a tutta loro struttura (tipologia, natura giuridica, ratio legis, elementi costitutivi e alle varie tipologie del dolo), le varie forme di confisca ( la confisca dei beni illecitamente esportati e la tutela del terzo, la confisca senza condanna, la confisca delle cose adoperate per commettere il reato, la confisca del prezzo, del prodotto e del profitto e la confisca per equivalente) e la responsabilità amministrativa delle persone giuridiche (D.Lgs n. 231/2001) che costituisce un corpus normativo di peculiare impronta, un tertium genus.
