L'étude comparée porte sur la notion de l'ordre public international et sa protéction dans les procédures de reconnaissance et d'exécution des jugements étrangers. Les règles procédurales que le juge doit suivre selon qu’il s'agisse du droit commun slovène ou français, ou bien des règlements communautaires, diffèrent d'une manière très importante. Cette “Théorie du ius cogens international” tente d’élaborer les bases d’une réflexion approfondie et d’une reconstruction nouvelle de cette notion ayant atteint une importance considérable dans la pratique et le droit internationaux. Dans un premier temps, elle offre une revue méticuleuse des théories existantes mettant en lumière leurs implications. Elle essaye, dans un deuxième temps, de reconstruire la notion de droit impératif à partir de la tradition juridique générale. Le ius cogens n’est pas limité aux normes d’ordre public, protégeant des intérêts sociaux ou moraux fondamentaux. Il s’étend en particulier à toute norme porteuse d’une utilitas publica. Le ius cogens s’identifie dès lors à la notion de “droit public” aus sens large. Ainsi le ius cogens se présente comme une technique du droit qui vise à maintenir l’unité et l’intégrité d’un régime juridique en interdisant sa fragmentation normative en régimes restreints, applicables prioritairement inter partes, et ce quand le législateur a prévu cette indérogabilité en raison d’un intérêt public ou collectif. C’est cette notion du ius cogens qui est appliquée ici au droit international. Cette étude se distingue par son originalité, sa rigueur ainsi que par la richesse des matériaux consultés et produits. Elle tranche sur l’abondante littérature consacrée au ius cogens par l’adoption d’une nouvelle approche, ouvrant une série de perspectives insoupçonnées.
