English summary: Although criminal law was generally able to elude the guidelines from Brussels for a long time due to its particularly close association with national sovereignty and with the cultural identity of the EU Member States, German criminal law has been influenced by directives from Brussels as well for several years. European directives on the protection of the environment through criminal law are measures for imposing sanctions in order to enforce the environmental policies of the European Community, but they are also an integral part of national criminal law. This tense relationship has led to a dispute concerning the proper location for a Europeanization of environmental criminal law, a decision made by the European Court of Justice on September 13, 2005. Martin Heger begins by explaining the Europeanization of environmental criminal law from the perspective of European law, compares this to German environmental criminal law and examines its need for change in view of the latest proposal for a Directive on the protection of the environment through criminal law. German description: Nachdem das Strafrecht aufgrund seiner traditionell besonders engen Verbindung zur nationalen Souveranitat und zur kulturellen Identitat der EU-Mitgliedstaaten lange von Vorgaben aus Brussel weitgehend verschont geblieben war, werden seit einigen Jahren deutsche Strafgesetze auch durch Brusseler Vorgaben beeinflusst. Seit Beginn der Mindestharmonisierung des materiellen Strafrechts mittels Rahmenbeschlussen und Richtlinien gilt das Umweltstrafrecht wegen der typischerweise grenzenlosen Auswirkungen der Umweltverschmutzung geradezu als Prototyp einer derartigen Europaisierung des Strafrechts. Europaische Vorgaben zum Umweltstrafrecht sind dabei einerseits Sanktionsmittel zur Durchsetzung der EG-Umweltpolitik, zugleich aber auch integraler Bestandteil des nationalen Strafrechts. Dieses Spannungsverhaltnis fuhrte zu einem Streit uber den richtigen Standort einer Europaisierung des Umweltstrafrechts, der die Europaische Union in eine tiefe intra-institutionelle Krise sturzen sollte. Erst der EuGH zerschlug mit seinem Grundsatzurteil vom 13.9.2005 den gordischen Knoten und machte damit den Weg frei fur einen neuen Richtlinienentwurf. Martin Heger nimmt dies zum Anlass und beleuchtet die Europaisierung des Umweltstrafrechts zunachst aus europarechtlicher Sicht, stellt dem dann den Gegenstand dieser Europaisierung - das deutsche Umweltstrafrecht de lege lata - gegenuber und pruft dessen Anderungsbedarf im Lichte dieses Richtlinienentwurfs sowie fruherer Rechtssetzungsvorschlage.

Fifty years after the famous essay “The Problem of Social Cost” (1960) by the Nobel laureate Ronald Coase, Law and Economics seems to have become the lingua franca of American jurisprudence, and although its influence on European jurisprudence is only moderate by comparison, it has also gained popularity in Europe. A highly influential publication of a different nature was the Brundtland Report (1987), which extended the concept of sustainability from forestry to the whole of the economy and society.
