This book questions the correctness of these assumptions and aims for further study of them. This is done by disentangling and illuminating the different elements underlying the interrelationship between the Court and the national courts. The objective is to distinguish between the requirements set by the Court; the constitutional powers and competences of national courts to interpret and apply international law, in particular the Convention; the way in which these courts actually use these competences to deal with the Court's interpretative approaches; and the type of criticism that is levelled at the Court's case-law. These elements are studied from the perspective of the Court as well as from a national perspective, in particular for Belgium, France, Germany, the Netherlands, Sweden and the United Kingdom. Analysing these elements separately enables a fruitful assessment of their interrelationship and provides a sound basis for a constructive debate on the implementation of the Convention in national law, which is based on solid constitutional foundations rather than assumptions and intuitions. The current book is therefore of great interest to those who are interested in debates on the interrelationship between the Court and the states - scholars, as well as judges, policy makers and politicians - but also to those who take a more general interest in constitutional implementation mechanisms, judicial powers and judicial argumentation.

What is an organization? What are the building blocks that ultimately constitute this social form, so pervasive in our daily life? Like Augustine facing the problem of time, we all know what an organization is, but we seem unable to explain it. This book brings an original answer by mobilizing concepts traditionally reserved to linguistics, analytical philosophy, and semiotics. Based on Algirdas Julien Greimas’ semio-narrative model of action and Jacques Derrida’s concept of écriture, a reconceptualization of speech act theory is proposed in which communication is treated as an act of delegation where human and nonhuman agents are mobilized (texts, machines, employees, architectural elements, managers, etc.). Perfectly congruent with the last development of the sociology of translation developed by Michel Callon and Bruno Latour, this perspective illustrates the organizing property of communication through a process called ‘interactoriality’. Jacques Lacan used to say that the unconscious is structured like a language. This book shows that a social organization is structured like a narrative.

This is the first book in English to study the history of the Estates General of Burgundy during the classic period of absolute monarchy. Although not a representative institution in any modern sense, the Estates were constantly engaged in a process of bargaining with the French crown, and this book examines that relationship under the Ancien Régime. Julian Swann analyses the organization, membership and powers of the Estates and explores their administration, their struggles for power with rival institutions and their relationship with the crown and with the Burgundian people.
