One of the most significant changes in the British House of Commons has been the development in 1979 of a system of select committees charged with monitoring government ministries. Unlike previous experiments in parliamentary reform, these committees are staffed exclusively with backbench MPs, who regularly review executive policies and offer recommendations. Michael Jogerst reappraises the relationship between the executive and legislative branches in light of these new circumstances, which are likely to affect the entire governmental structure of the United Kingdom.

Excerpt from Thoughts on Moderate Reform in the House of Commons To the Noble Lord who has thus taken the lead as the Champion of Constitutional and Moderate Reform, the country is already singularly indebted, for it is to his exertions we owe the memorable repeal of the Corporation and Test Acts, which first opened the eyes of the Ministry to the possibility of Catholic Emancipation; and when he shall succeed in his present object, as I doubt not but eventually he will do, he will add another leaf to the Civic Crown which the applause of his countrymen has already bound around his brows. The proposal has been, however, for the present, rejected - by a small majority. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. This paper sets out proposed reforms of the House of Commons, as a basis for consultation. The reforms are designed to create a modern and more effective system for the parliamentary scrutiny of government, both in terms of its executive actions and in its legislation. The measures also aim to make the work of the Commons more accessible to the public and raise levels of public respect for Parliament. The proposed reforms include: shortening the length of parliamentary debates; reducing the notice period required for tabling a ministerial question at Question Time; the publication of Bills in draft form; enabling Bills to be carried over from one Session to the next; methods for scrutiny of the implementation of new laws and secondary legislation; changing the pattern of sitting hours, including an earlier start for proceedings in the Chamber and increased time for constituency work; altering recess periods; the introduction of modern technology for House procedures, including an electronic method of voting; widening press coverage of Parliamentary proceedings; live coverage of public committee proceedings on the internet; and an increased education service for schoolchildren. It does not offer proposals on the Select Committee system, as this issue will be covered in a forthcoming report by the Modernisation Committee.

The history of reform of the House of Lords has a long history since the Parliament Act 1911, and since the House of Lords Act 1999 removed the right of all but 92 hereditary peers to sit in the Lords, there has been a number of initiatives to further the debate on reform. The latest proposals are contained in the draft Bill (Cm. 8077, ISBN 9780101807722) published in May 2011, which was referred to the Joint Committee. In this report the Joint Committee acknowledges the controversial aspects of certain of the proposals and the members of the Committee reflect wider differences of opinion, many of the report's recommendations being decided by a majority. The majority supports the need for an electoral mandate, provided the House has commensurate powers. The current functions and role would continue, but the House would probably seek to be more assertive, to an extent that cannot be predicted. The Committee recommends a House of 450 members, 80% elected on a system of Single Transferable Voting (preferably that used in New South Wales, not the one proposed in the Bill) for a 15 year term. The main sections of the report cover: functions, role, primacy of the Commons and conventions; electoral system, size, voting system and constituencies; appointments, bishops and ministers; transition, salaries, IPSA, disqualification. The Committee recommends that, in view of the significance of the constitutional change, the Government should submit the decision to a referendum.

This is the first report from the House of Commons Reform Committee of the 2009-10 session (HCP 372), and follows an earlier report (HCP 1117, session 2008-09). The Committee aims to make the Commons matter more, increase its vitality and rebalance its relationship with the executive, and to give the public a greater voice in parliamentary proceedings. In the first two chapters the Committee sets out the wider background to its establishment in July 2009; seeks a prompt debate and decision on its proposals and their phased implementation; and describes the principles that have guided its work. The Committee recommends that the Chairs of departmental and similar select committees be directly elected by secret ballot of the House using the alternative vote. The Committee also recommends that members of departmental and similar committees should be elected from within party groups by secret ballot, and further recommends: (a) a reduction in the size of a standard departmental committee to not more than 11; (b) a Standing Order ensuring the election of members and Chairs of select committees within six weeks of the Queen's Speech; (c) the election by the House of the Chair of the Intelligence and Security Committee. The report looks at the prospects for some form of "agenda initiative" which might enable the public to ensure that a given issue is debated in the House. It concludes that opening up the process of legislation and giving the public a real opportunity to influence the content of draft laws should be a priority in the new Parliament.
