Este libro del profesor Allan R. Brewer-Carías, sobre Reforma constitucional y fraude a la Constitución (1999-2009), publicado por la Academia de Ciencias Políticas y Sociales, con un Prólogo del profesor Román José Duque Corredor, estudia el proceso de revisiones y modificaciones efectuadas en general en forma ilegítima de la Constitución en Venezuela, en el período entre 1999 y 2009. El libro está precedido en una Primera parte, de un estudio general de derecho comparado sobre los procedimientos de reforma constitucional en América Latina, y las modalidades de su control constitucional. En ese contexto comparado, se identifica con precisión el sistema venezolano de revisión constitucional que se estableció en la Constitución de 1999n mediante la enmienda constitucional, la reforma constitucional y la Asamblea nacional Constituyente, en los tres casos con la participación directa e indispensable del pueblo mediante referendo. En la Segunda parte el autor estudia el proceso constituyente desarrollado en Venezuela de 1999, mediante la sanción de la Constitución en 1999 por una Asamblea Nacional Constituyente que fue convocada al margen de la Constitución de 1961, que dio un golpe de Estado constituyente contra los poderes constituidos. La Tercera parte de la obra estudia la primera violación de la Constitución de 1999, luego de que fue aprobada por el pueblo y antes de que fuera publicada, mediante la adopción por la Asamblea Constituyente que ya había concluido su misión de un régimen transitorio no aprobado por el pueblo y que estableció una Constitución paralela. Las Cuarta y Quinta parte analizan la "reforma constitucional" propuesta en 2007 para transformar el Estado Constitucional en un Estado Comunal, y que luego de aprobada por la Asamblea Nacional en fraude a la Constitución y con la abstención del juez constitucional en controlar su constitucionalidad, fue sin embargo rechazada por el pueblo mediante referendo en diciembre de 2007. En la sexta parte del libro se analiza el proceso de "enmienda constitucional" de 2009 realizado con el propósito de permitir la reelección continua e indefinida, en violación del principio pétreo de la alternabilidad, y que fue por tanto aprobada en fraude a la Constitución. Y la Séptima parte se refiere al proceso de ilegítima mutación de la Constitución efectuada por la Sala Constitucional del Tribunal Supremo de Justicia puesto al servicio del autoritarismo, mediante "interpretaciones" establecidas a la medida, adoptadas en general a petición del gobierno, trastocando principios y regulaciones esenciales, y poniendo normas a decir lo que no establecen.

"All over the world, in all democratic States, independently of having a legal system based on the common law or on the civil law principles, the courts – special constitutional courts, supreme courts or ordinary courts – have the power to decide and declare the unconstitutionality of legislation or of other State acts when a particular statute violates the text of the Constitution or of its constitutional principles. This power of the courts is the consequence of the consolidation in contem-porary constitutionalism of three fundamental principles of law: first, the existence of a written or unwritten constitution or of a fundamental law, conceived as a superior law with clear supremacy over all other statutes; second, the “rigid” character of such constitution or fundamental law, which implies that the amendments or reforms that may be introduced can only be put into practice by means of a particular and special constituent or legislative process, preventing the ordinary legislator from doing so; and third, the establishment in that same written or unwritten and rigid constitution or fundamental law, of the judicial means for guaranteeing its supremacy, over all other state acts, including legislative acts. Accordingly, in democratic systems subjected to such principles, the courts have the power to refuse to enforce a statute when deemed to be contrary to the Constitu-tion, considering it null or void, through what is known as the diffuse system of judicial review; and in many cases, they even have the power to annul the said unconstitutional law, through what is known as the concentrated system of judicial review. The former, is the system created more than two hundred years ago by the Supreme Court of the United States, and that so deeply characterizes the North American Constitutional system. The latter system, has been adopted in consti-tutional systems in which the judicial power of judicial review has been generally assigned to the Supreme Court or to one special Constitutional Court, as is the case, for example, of many countries in Europe and in Latin America. This concentrated system of judicial review, although established in many Latin American countries since the 19th century, was only effectively developed particularly in the world after World War II following the studies of Hans Kelsen. Of course, during the past thirty years many changes have occurred in the world on these matters of Judicial Review, in particularly in Europe and specifically in the United Kingdom, where these Lectures were delivered. Nonetheless, I have decided to publish them hereto in its integrality, as they were: the written work of a law professor made as a consequence of his research for the preparation of his lectures, not pretending to be anything else, but the academic testimony of the state of the subject of judicial review in the world in 1985-1986". "La experiencia venezolana de convocatoria e instalación de una Asamblea Constituyente en 1999 que no estaba prevista ni regulada en la Constitución entonces vigente de 1961 fue una manifestación de populismo constitucional cuyas lecciones deben conocerse, para no repetirse, como sin embargo se hizo en Ecuador unos años después (2007), pues en la misma se violaron todos los principios más elementales del constitucionalismo moderno. El constitucionalismo moderno, por tanto, no sólo está montado sobre el principio de la soberanía popular sino sobre el de la supremacía y rigidez constitucional, lo que implica que para llevar a cabo una reforma de la Constitución los tres principios han de ser observados y ninguno de ellos puede prevalecer en sacrificio de los otros. La soberanía popular debe respetarse siempre que se manifieste de acuerdo con la propia voluntad popular expresada en la Constitución, y la supremacía constitucional no puede ser relegada bajo la excusa de que el pueblo quiere manifestarse. Por lo que se refiere a la rigidez constitucional, la misma debe regularse de manera de permitir los cambios y la adaptación de la Constitución mediante normas que permitan a la voluntad popular expresarse, de manera de asegurar que los hechos no desmoronen el derecho. Ahora, y en vista de que en Chile se ha iniciado un proceso constituyente mediante la convocatoria de una Convención Constitucional producto de una reforma puntual a la Constitución realizada en 2019 para regular su composición y funcionamiento, como consecuencia de un amplo acuerdo político logrado entre todos los actores de la sociedad – es decir, la antítesis de lo que ocurrió en Venezuela, Ecuador y Bolivia -; y que tiene el enorme reto de sancionar una nueva Constitución que sea el resultado de consensos y no la imposición de un texto por un grupo sobre todos los otros de la sociedad; y que en el Perú el nuevo Presidente anuncia el propósito de iniciar otro proceso constituyente el cual debe estar enmarcado en las previsiones que resulten de la necesaria reforma previa de la Constitución efectuada mediante Ley por el Congreso, en la cual se regule la Asamblea Constituyente; Ediciones Olejnik ha estimado de interés publicar esta pequeña obra que resume en grandes líneas el proceso constituyente venezolano de 1999 que, como se dijo, fue realizado al margen de la Constitución entonces vigente, y en violación de los más elementales principios del constitucionalismo moderno, siendo el resultado del mismo no solo la sanción de una Constitución que no se ha cumplido, y que se comenzó a violar desde antes de ser publicada; sino la conformación de un régimen autoritario basado en la mentira como política de Estado".
