Analyses the likely future of the EU following next year's Intergovernmental Conference (IGC) which is likely to be even more significant for the future of Europe than the Maastricht Treaty. Since Maastricht it has become clear that future developments are less certain with regard to the EU and integration. The IGC will have to try and resolve tensions such as: "widening" Europe to include former communist countries whislt also trying to "deepen" Europe with increased political and economic integration; providing a framework which is acceptable to a core of countries (Benelux, Germany, France) who favour more integration and an early move to monetary union with countries such as the UK, which does not.

For decades the European Union tried changing its institutions, but achieved only unsatisfying political compromises and modest, incremental treaty revisions. In late 2009, however, the EU was successfully reformed through the Treaty of Lisbon. Reforming the European Union examines how political leaders ratified this treaty against all odds and shows how this victory involved all stages of treaty reform negotiations--from the initial proposal to referendums in several European countries. The authors emphasize the strategic role of political leadership and domestic politics, and they use state-of-the-art methodology, applying a comprehensive data set for actors' reform preferences. They look at how political leaders reacted to apparent failures of the process by recreating or changing the rules of the game. While domestic actors played a significant role in the process, their influence over the outcome was limited as leaders ignored negative referendums and plowed ahead with intended reforms. The book's empirical analyses shed light on critical episodes: strategic agenda setting during the European Convention, the choice of ratification instrument, intergovernmental bargaining dynamics, and the reaction of the German Council presidency to the negative referendums in France, the Netherlands, and Ireland.

The Lisbon Treaty reformed the foundations of the European Union and marked the culmination of a process of Treaty reform that began after the Treaty of Nice and spanned almost a decade. This book addresses the main innovations made by the new Treaty, examining its legal and political consequences in a reformed EU. The book is organized thematically around the principal issues that occupied those engaged in the reforms over the last decade. The chapters include analysis of the reform process itself and the political forces that shaped the relevant provisions of the Lisbon Treaty. The book contains detailed analysis of the relevant legal changes made by the Lisbon Treaty on each topic covered. This legal analysis is informed by broader literature from related disciplines, such as political science and international relations, since it is only by doing so that it is possible fully to understand the legal implications of the new provisions dealing with issues such as the inter-institutional division of power within the EU, the distribution of competence, the hierarchy of legal acts and the Charter of Rights. The book addresses the political and legal implications of the Treaty provisions, and the discussion is set against the background of the pre-existing legal and political regime, aiding a full understanding of the effect of the new rules contained in the Lisbon Treaty. This revised paperback edition includes a new chapter detailing the political reform process leading to the proposed Fiscal Union Treaty, and its potential legal implications.

The radical changes taking place in the international scene during the late 1980s have presented the European Communities with important new challenges. The twelve Member States agreed that the only way to respond effectively to this new situation was to speed up the European integration process, and in December 1990 two Intergovernmental Conferences were inaugurated, focusing respectively on the development of an Economic and Monetary Union and a Political Union. It was the difficult task of the Luxembourg and Dutch Presidencies to channel the often very diverging positions of the different actors in the process into one coherent set of amendments to the Treaties forming the European Communities. This publication examines the positions which the different Member States, the Commission and the European Parliament have been defending in the Intergovernmental Conference on Political Union and more particularly with regard to one of the most sensitive topics under discussion, namely the development of a Common Foreign and Security Policy (CFSP). The introduction places the debate on the development of a Political Union and a CFSP in an historical perspective and gives an overview of the progression of the negotiations. The concluding chapter presents a general framework for better understanding of the course and results of the negotiations, and a critical evaluation of the outcome. The annexes reproduce the main proposals on the development of a CFSP submitted to the Conference.

This electronic version has been made available under a Creative Commons (BY-NC-ND) open access license. This substantially updated and revised edition offers a comprehensive overview of the challenges confronting the political system as well as the international politics of the European Union. It draws from a spectrum of regional integration theories to determine what the Union actually is and how it is developing, examining the constitutional politics of the European Union, from the Single European Act to the Treaty of Nice and beyond. The ongoing debate on the future of Europe links together the questions of democracy and legitimacy, competences and rights, and the prospects for European polity-building. The aim is to contribute to a better understanding of the emerging European polity and the questions that further treaty reform generates for the future of the regional system. The authors also assess the evolving European security architecture; the limits and possibilities of a genuine European foreign, security and defence policy; and the role of the EU in the post-Cold War international system. Common themes involve debates about stability and instability, continuity and change, multipolarity and leadership, co-operation and discord, power capabilities and patterns of behaviour. The book traces the defining features of the ‘new order’ in Europe and incorporates an analysis of the post-September 11th context.
