Legal Aspects of the Regional Integration Processes in the Post-Soviet Area is the first ever comprehensive overview of regional integration processes in the territory of the former USSR introducing the core concepts of regional integration theory and presenting a solid foundation of factual information regarding all the regional integration agreements (RIAs) operating in the Eurasian landmass and consisting of the former Soviet republics. The book analyzes the legal nature and background of the regional integration in the framework of the Commonwealth of Independent States, the Russian-Belarusian Union, the Single Economic Space, the Eurasian Economic Community and the Collective Security Treaty Organization. There is very little alternative to further regional economic integration within the CIS area. The “core” group of the CIS Member States is pushing forward the enhanced economic agenda. It is argued that the eventual establishment of the CIS free trade area/customs union would contribute to dismantling discriminatory obstacles of mutual access to the CIS markets. In short term dimension, further CIS economic integration would protect fragile CIS industries and business from highly competitive international goods and services after joining WTO. However, one has to consider if these short term recipes suit long term appetites of all CIS Member States that seriously consider themselves as part of the European space. In the meantime, these countries face a puzzling dilemma. On one hand, pro Western CIS Member States (Ukraine and Moldova) keep being cautious about sacrificing their European aspirations to unpredictable trade arrangements within the CIS. On other hand, these countries meet lukewarm response from the EU to their insisting free trade area proposals. Thus, a key for the next CIS integration programme could be hidden in Europe, or in other words, in European attitude towards further eastward enlargement.

This book explores the implications of European and Eurasian integration projects for the constitutional orders of post-Soviet countries. On the one hand, the process of Eurasian integration, culminating in the establishment of the Eurasian Economic Union (EAEU), led to the creation of new institutions and mechanisms influencing the domestic legal order of the participating countries. On the other hand, the process of European integration, epitomised through the European Union (EU), constitutes an important source of reference for domestic constitutional developments in the countries which recently concluded a new generation of Association Agreements with the EU. This book analyses the implications of both processes. The book addresses the relevant experience of the countries from Central and Eastern Europe with transitional constitutionalism, mapping out the significance of European and Eurasian integration for protecting the rule of law in the post-Soviet space and identifying the constitutional implications and challenges of the EAEU and the new generation of Association Agreements. While we know a great deal about the benefits of regional integration, there is a knowledge gap when it comes to areas with weak, dysfunctional, or nonexistent regional fabric in political and economic life. Further, deliberate “un-regioning,” applied by actors external as well as internal to a region, has also gone unnoticed despite its increasingly sophisticated modern application by Russia in its peripheries. This volume helps us understand what Anna Ohanyan calls “fractured regions” and their consequences for contemporary global security. Ohanyan introduces a theory of regional fracture to explain how and why regions come apart, consolidate dysfunctional ties within the region, and foster weak states. Russia Abroad specifically examines how Russia employs regional fracture as a strategy to keep states on its periphery in Eurasia and the Middle East weak and in Russia's orbit. It argues that the level of regional maturity in Russia’s vast vicinities is an important determinant of Russian foreign policy in the emergent multipolar world order. Many of these fractured regions become global security threats because weak states are more likely to be hubs of transnational crime, havens for militants, or sites of protracted conflict. The regional fracture theory is offered as a fresh perspective about the post-American world and a way to broaden international relations scholarship on comparative regionalism.
