Abstract: This study answers the question: How can campus hate speech be regulated constitutionally? Three distinct methodologies bear on this question: 1) conventional legal methods of research and analysis; 2) critical legal methods; and 3) qualitative methods of empirical research. Conventional legal methods discover decision rules presently followed by courts adjudicating campus hate speech rules. Critical legal methods reveal rupture points in the conventional application of First Amendment law. Then, critical methods suggest the narrative stories of people marginalized by conventional application can be interjected into these rupture points, as persuasive evidence to change the law. In this study, qualitative methods of data collection and analysis generate such narratives. The legal principle grounding empirical inquiry is that campus hate speech regulation is constitutional when the rule is narrowly tailored to serve a compelling interest. This study concludes: a university can regulate campus hate speech constitutionally because campus hate speech impairs a university's compelling interest in providing equal educational opportunity.

Opponents of speech codes often argue that liberal academics use the codes to advance an agenda of political correctness. But Jon B. Gould's provocative book, based on an enormous amount of empirical evidence, reveals that the real reasons for their growth are to be found in the pragmatic, almost utilitarian, considerations of college administrators. Instituting hate speech policy, he shows, was often a symbolic response taken by university leaders to reassure campus constituencies of their commitment against intolerance. In an academic version of "keeping up with the Joneses," some schools created hate speech codes to remain within what they saw as the mainstream of higher education. Only a relatively small number of colleges crafted codes out of deep commitment to their merits. Although college speech codes have been overturned by the courts, Speak No Evil argues that their rise has still had a profound influence on curtailing speech in other institutions such as the media and has also shaped mass opinion and common understandings of constitutional norms. Ultimately, Gould contends, this kind of informal law can have just as much power as the Constitution.

I review arguments favoring bans on problematic speech (e.g., hate speech) on campus. Contrasting such calls for top-down regulation, I explore the potential for a Bottom-up approach to campus speech governance to address vexing concerns pertaining to campus speech without violating free speech and academic freedom principles. I examine the political economy and epistemological dynamics inherent within the two forms of governance. I argue that, relative to a centralized top-down approach, a decentralized bottom-up approach to speech governance avoids political dynamics that bend toward the inappropriate use of power. Further, I argue that a bottom up approach leaves the discursive space contestable, and therefore more open to new discovery and correction. Recognizing that a bottom up approach is no panacea, I also consider open questions and concerns that warrant further inquiry.
