Using annual data on 80 countries for 1980-2007 and a new indicator of product market regulation, this paper studies the effects of product market regulation on labor market performance among the total population as well as among two important groups of labor market outsiders: women and youth. It finds that stricter regulation is likely to both increase the unemployment rate and decrease the employment rate. The magnitude of the estimated effects is substantial. There are above-average effects on both groups of outsiders, with the effects being particularly strong on youth. The results are robust to variations in specification.

The effect of public regulation on the labor market: detailed analyses of a wide range of policy interventions. The six studies collected in this CESifo volume analyze the sometimes unpredictable effects of public regulation on the labor market. The first three chapters of Labor Market Institutions and Public Regulation present empirical findings, comparing the effects of job training and subsidized employment on the Swedish labor market, analyzing the effect of extended unemployment benefits on unemployment duration for older Austrian workers, and examining poor labor market performance in Spain even after policy reforms. The following chapters take a more theoretical approach, applying the analytical tools of theory to policy issues. These three studies examine the general equilibrium repercussions of public support for both basic and higher education, develop an efficiency wage model to analyze mandated severance pay, and compare different kinds of redistribution to low-skill workers financed by an increased tax on capital.

This paper offers a critique of recent empirical research on the impact of labour regulation on industrial performance in India. It begins with a review of earlier studies that tried to infer the effects on manufacturing employment of amendments made by the central government to the Industrial Disputes Act (IDA) in 1976 and 1982, requiring official permission for layoffs, retrenchments and closures. The results of these studies are ambiguous, and this literature ignored crucial developments in the political and legal spheres which vitiate many of these findings. The widely-used index of state-level labour regulation devised by Besley and Burgess (Quarterly Journal of Economics, 2004) is then criticised for its miscoding of individual amendments and its misleading aggregation and cumulation procedures. Their econometric results, which indicate that states that enacted excessively pro-worker amendments to the IDA have displayed poorer performance in manufacturing, do not appear to be robust and also suffer from other methodological problems. Several recent studies that have used the Besley-Burgess index are also surveyed, and their limitations highlighted. Finally, the paper reviews a wide range of other evidence, pointing in a very different direction, on the actual enforcement of labour laws, labour flexibility, and industrial employment. Throughout, attention is paid to the crucial role of judicial interpretation of the IDA, which has been neglected in this literature.

This study, on the role of flexibility and security on labour market performance, argues that flexicurity is the most relevant approach for Central and Eastern European countries. The book follows the pattern of analysis used in "Labour markets in transition", a previous monograph by the authors, and re-examines the different dimensions of flexibility, including flexible forms of employment. It studies fluctuations of labour turnover over the economic cycle. Then it review changes in the regulatory provisions, collective bargaining, labour taxation and labour market policies and their impacts on key labour market indicators for the period 1999-2003 as compared with the end of the 1990s. Through a series of national case studies, the volume examines how the countries of Croatia, Bulgaria, Hungary, Lithuania and Poland have attempted to balance labour market flexibility and security since the late 1990s. A discussion on wage flexibility is also included. The search for abetter combination of flexibility and security has been a major challenge within the European Union and it is often seen as indispensable for improving competitiveness and at the same time maintaining the European social model. This book looks into how this can be achieved through the flexicurity approach and shows how "activation" of labour market policies and social dialogue can be the keys to success.
