New Perspectives On Power And Political Representation From Ancient History To The Present Day written by and has been published by BRILL this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-06-07 with Literary Criticism categories.

New Perspectives on Power and Political Representation from Ancient History to the Present Day offers a unique perspective on political communication between rulers and ruled from antiquity to the present day by putting the concept of representation center stage. It explores the dynamic relationship between elites and the people as it was shaped by constructions of self-representation and representative claims. The contributors to this volume – specialists in ancient, medieval, early-modern and modern history – move away from reductionist associations of political representation with formal aspects of modern, democratic, electoral, and parliamentarian politics. Instead, they contend that the construction of political representation involves a set of discourses, practices, and mechanisms that, although they have been applied and appropriated in various ways in a range of historical contexts, has stood the test of time.

Preemption Choice written by William W. Buzbee and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2008-12-15 with Law categories.

This book examines the theory, law, and reality of preemption choice. The Constitution's federalist structures protect states' sovereignty but also create a powerful federal government that can preempt and thereby displace the authority of state and local governments and courts to respond to a social challenge. Despite this preemptive power, Congress and agencies have seldom preempted state power. Instead, they typically have embraced concurrent, overlapping power. Recent legislative, agency, and court actions, however, reveal an aggressive use of federal preemption, sometimes even preempting more protective state law. Preemption choice fundamentally involves issues of institutional choice and regulatory design: should federal actors displace or work in conjunction with other legal institutions? This book moves logically through each preemption choice step, ranging from underlying theory to constitutional history, to preemption doctrine, to assessment of when preemptive regimes make sense and when state regulation and common law should retain latitude for dynamism and innovation.

Lawyers Swamps And Money written by Royal C Gardner and has been published by Island Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2011-04-15 with Business & Economics categories.

Lawyers, Swamps, and Money is an accessible, engaging guide to the complex set of laws governing America's wetlands. After explaining the importance of these critical natural areas, the book examines the evolution of federal law, principally the Clean Water Act, designed to protect them. Readers will first learn the basics of administrative law: how agencies receive and exercise their authority, how they actually make laws, and how stakeholders can influence their behavior through the Executive Branch, Congress, the courts, and the media. These core concepts provide a base of knowledge for successive discussions of: the geographic scope and activities covered by the Clean Water Act the curious relationship between the U.S. Army Corps of Engineers and the Environmental Protection Agency the goal of no net loss of wetlands the role of entrepreneurial wetland mitigation banking the tension between wetland mitigation bankers and in-lieu fee mitigation programs wetland regulation and private property rights. The book concludes with insightful policy recommendations to make wetlands law less ambiguous and more effective. A prominent legal scholar and wetlands expert, professor Royal C. Gardner has a rare knack for describing landmark cases and key statutes with uncommon clarity and even humor. Students of environmental law and policy and natural resource professionals will gain the thorough understanding of administrative law needed to navigate wetlands policy-and they may even enjoy it.
