Zunächst wird die aktuelle Rechtslage dargestellt, um die Änderungsvorschläge nachfolgend erörtern und dahingehend überprüfen zu können, wie diese den unionsrechtlichen Rechtsbegriff beeinflussen. Danach gilt es zu beurteilen, ob der unionsrechtliche Rechtsbegriff der Marke nach den Änderungsvorschlägen ein fortschrittlicher ist, der auf die Entwicklung seit den Veröffentlichungen (1988 und 1993) in technologischer Sicht ein-geht oder ob die tatsächlichen Gegebenheiten nicht berücksichtigt werden. Außerdem werden die Harmonisierung und die Vereinheitlichung auf den Prüfstand gestellt und ebenfalls hin-sichtlich des gemeinsamen Binnenmarktes beleuchtet. Konkretes Ziel der Arbeit ist es, die Bedeutung und Rechtssystematik des Markenrechts zu veranschaulichen und zu bewerten, ob dies durch die Änderungsvorschläge konsequent fortgeführt wird.

The ever increasing relevance of European law which involves replacement or supplementation of and interaction with national law not only affects the states in Europe but also, and foremost, the citizens. The rights of the citizens in Europe are protected by the European Fundamental Rights and Freedoms. The aim of this textbook is to grasp and illustrate the meaning of these rights and to integrate it into a coherent system. For this purpose the book not only deals with the pertinent law of the European Union and the European Community, but also with the European Convention for the Protection of Human Rights and Fundamental Freedoms which, too, is becoming more and more important. In addition, regard is had to the Charter of Fundamental Rights of the Union which forms part of the Treaty establishing a Constitution for Europe. Although the Charter is not yet legally binding since the Constitution has not been ratified by all EU Member States, the Community Courts already make reference to it as a concentrate of the constitutional traditions common to the Member States. It therefore does not seem entirely unlikely that the Charter might be included into the existing Treaties irrespective of the future constitutional developments on the EU level. On a similar anticipatory basis the book also takes into account those Protocols to the European Convention for the Protection of Human Rights and Fundamental Freedoms that have not yet entered into force.

This third volume in a series on Comparative Succession Law concerns the entitlement of family members to override the provisions of a deceased person's will to obtain money or assets (or more money or assets) from the person's estate. Some countries, notably those in the civil law tradition (such as France or Germany), confer a pre-ordained share of the deceased's estate or of its value on certain members of the deceased's family, and especially on the deceased's children and spouse. Other countries, notably those in the common law tradition (such as England, Canada, or Australia), leave the matter to the discretion of the court, the amount awarded depending primarily on financial need. Whichever form it takes, mandatory family provision is both a protection against disinheritance and also, therefore, a restriction on testamentary freedom. The volume focuses on Europe and on countries influenced by the European experience. In addition to detailed treatment of the law in Austria, England and Wales, France, Germany, Hungary, Italy, the Netherlands, Norway, Poland, Scotland, and Spain, the book also has chapters on Australia and New Zealand, South Africa, the United States, Canada, the countries of Latin America, and the People's Republic of China. Niels Hemmingsen (1513-1600) is one of the most influential Danish theologians in history. As a professor at the University of Copenhagen, Hemmingsen played an important role in moulding Danish society according to his understanding of Lutheranism during the second half of the sixteenth century. Drawing on sociology of knowledge, cultural memory, and confessional culture, Mattias Skat Sommer examines Hemmingsen's works and life in political and theological contexts. By studying Hemmingsen's role in forming a discourse of social interaction, the author argues that Hemmingsen was the leading agent in shaping post-Reformation Danish confessionalization.
