Derived from the renowned multi-volume International Encyclopaedia of Laws, this convenient resource provides systematic information on howand Sweden deals with the role religion plays or can play in society, the legal status of religious communities and institutions, and the legal interaction among religion, culture, education, and media. After a general introduction describing the social and historical background, the book goes on to explain the legal framework in which religion is approached. Coverage proceeds from the principle of religious freedom through the rights and contractual obligations of religious communities; international, transnational, and regional law effects; and the legal parameters affecting the influence of religion in politics and public life. Also covered are legal positions on religion in such specific fields as church financing, labour and employment, and matrimonial and family law. A clear and comprehensive overview of relevant legislation and legal doctrine make the book an invaluable reference source and very useful guide. Succinct and practical, this book will prove to be of great value to practitioners in the myriad instances where a law-related religious interest arises in Sweden. Academics and researchers will appreciate its value as a thorough but concise treatment of the legal aspects of diversity and multiculturalism in which religion plays such an important part. and and and and

This book presents a comprehensive history of law and religion in the Nordic context. The entwinement of law and religion in Scandinavia encompasses an unusual history, not widely known yet important for its impact on contemporary political and international relations in the region. The volume provides a holistic picture from the first written legal sources of the twelfth century to the law of the present secular welfare states. It recounts this history through biographical case studies. Taking the point of view of major influential figures in church, politics, university, and law, it thus presents the principal actors who served as catalysts in ecclesiastical and secular law through the centuries. This refreshing approach to legal history contributes to a new trend in historiography, particularly articulated by a younger generation of experienced Nordic scholars whose work is featured prominently in this volume. The collection will be a valuable resource for academics and researchers working in the areas of Legal History and Law and Religion.

"In most European societies today, religion and questions about religion are increasing in relevance and importance. This development can be explained in several ways, for example by continuous demographic changes and new societal standards and values. As a consequence, the debate on the interpretation and scope of the right to freedom of religion has intensified in politics, media and, of course, law. The right to freedom of religion is complex and varies within different legal contexts at the international, European and national levels. This has resulted in a right that is ambiguous and sometimes difficult for individuals to claim and for states to assert. This book presents a variety of perspectives on the concept of freedom of religion in different European countries against the background of the European Convention on Human Rights, the EU Charter of Fundamental Rights and other international treaties. It contains contributions from leading legal scholars working in these fields in Sweden, the Nordic countries and wider Europe."--

How are Western, mostly secular, societies handling religion in its increasingly pluralistic and complex forms? What different forms of interactions between and negotiations of religion and religious beliefs can we see in contemporary society? What are the primary contenders in these interactions and negotiations? The authors of Religion, Law and Democracy give ample examples of a variety of interaction processes between different expressions of religion and different spheres of society, such as the media, the judicial systems and state administration and policy. The authors primarily approach these questions from a North European but also to some extent a global perspective. A common denominator is a dynamic perspective on the relation between religious organizations, society and the individual actors - in other words how all of these levels are interconnected and transformed in these processes.

This collection discusses how official legal systems do and should respond to the reality of a plurality of family types and origins within their jurisdictions. It further examines the challenges that arise for practitioners, including lawyers and judges, when faced with such plurality. Focussing on empirical research, the volume presents legal and sociological data of unprecedented comparative depth. It also includes a discussion of how members of minority families respond to the need to organise their legal relationships, and to resolve their disputes in the shadow of official legal systems which differ from those of their familial and communal traditions. The work invites reflection, and demonstrates the urgency and complexity of the questions regarding the search for justice in the field of family life in Europe today.

Caspar David Friedrich's painting on the cover of this book is a metaphor: Scholarly relations between law & religion seemed to be destroyed through modernity. The book however argues for new life in the ruins. --

The State And Religious Minorities In Sweden written by Linnea Lundgren and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2023-10-24 with Social Science categories.

This book, a revised version of Lundgren’s PhD thesis, offers a deepened understanding of the changes in the governance of religious diversity and the complex relationship between state and religion. Linnea Lundgren explores how the narrative of risk and resource came to be by looking beyond the developments in the last few decades (particularly since 9/11) and analysing how the governance of religious diversity has developed over time. In particular, she focuses on the case of Sweden that is often regarded as one of the most secular countries in the world, while simultaneously being recognised as one of the most multi-religious countries in Europe due to a rise in immigration. This book reveals how the state has had a central role in setting the terms and conditions that both enable and limit what religious communities can do, thus shaping the function and role of religion in the public realm. Through the analysis of an extensive number of government documents over a period of seventy years (1952-2022), Lundgren challenges the idea that many of the recent controversies concerning religious diversity are new. She argues that many of the discussions held today regarding the accommodation of Muslims are decidedly similar to previous discussions regarding the management of Catholics and the Free Churches in the 1950s and 1960s. She shows that the underlying fear has remained the same; that the individual’s rights can become weakened or diminished in religious communities and that religious minorities will challenge the common shared values of the society. In light of this Lundgren concludes that in order to understand what is really at stake in the debate regarding religious diversity in Sweden today, there is a need to look at underlying tensions that exist between the state, civil society and the individual, a relationship that differs considerably in the Nordic context compared to other contexts. This text appeals to students and researchers working in the sociology of religion and people who work with governance of religion, religion and civil society, and religion and law in Europe.
