The Labour Government's proposals for reform of the UK's internal constitutional arrangements promise the most wide-ranging and substantial overhaul of the constitution this century. Their plans, which include devolution for Scotland and Wales, incorporation of the ECHR, a Freedom of Information Bill and reform of both houses of Parliament are already far progressed, but critical choices have still to be made. Against this background, and in view of these historical events, the Directors of the Centre for Public Law at the University of Cambridge recently organised a major conference to discuss the legal and practical implications of the proposed reforms. Speakers at the conference included leading academics, barristers, solicitors, judges and politicians. The results, which are reproduced in this volume of conference proceedings, will be essential reading for all those interested in constitutional reform and in British political history.

This book examines the extent to which Brexit has impacted upon the operation of the British Constitution, prompting in turn consideration of how some of the factors which contributed to the outcome of the 2016 referendum, as well as the event of Brexit itself, might inform debates surrounding constitutional reform moving forward. The work seeks to make sense of the constitutional implications of Brexit and to revisit some of the key debates that have taken place in respect of particular constitutional reform proposals in order to assess the extent to which recent Brexit-related developments inform the perspectives which are taken upon their merits and prospects. The book is divided into two parts. The first provides some context for the substantive treatment of the potential impact of Brexit on constitutional reform debates which forms the focus of Part II. Part II centres on various specific constitutional reform themes or issues, which are explored further within the context of Brexit. For each such issue, the main parameters of the debates which have taken place are sketched out before moving on to consider how it has informed, or may come to be informed, by the phenomenon of Brexit. By so doing, it looks to some future directions for constitutional reform which take account of the factors driving the discourses which gave rise to the referendum outcome and subsequent developments, as well as offering meaningful responses to these. The book will be of interest to academics, researchers and policy-makers working in the areas of constitutional law, constitutional politics, philosophy and history.

This book presents the remarkable constitutional reforms undertaken by the Blair and Brown governments in the UK. The reforms are remarkable in that they had the potential to change the way Britons understood the national identity of the UK. The book illuminates the ambitions of the key players in Whitehall and Westminster and is enriched through a study of comparable constitutional reforms in Canada and Australia: the Charter of Rights and Freedoms pioneered by Pierre Trudeau and the attempt by Paul Keating to make Australia a Republic. The Canadian and Australian chapters are a contribution to the political history of those nations and a device for understanding the changes in Britain. The author is an expert in the use of Freedom of Information and was a senior policy maker in Whitehall working primarily on constitutional reform. Readers will benefit from the author's unrivalled access to interviewees and documentary sources in the three countries covered in the book.

The New Labour government first elected in 1997 had a defining influence on the development of the modern UK constitution. This book combines legal and political perspectives to provide a unique assessment of the way in which this major programme of constitutional reform has changed the nature of the UK constitution. The chapters, written by leading experts in UK public law and politics, analyse the impact and legacy of the New Labour reform programme some 20 years on from the 1997 general election, and reveal the ways in which the UK constitution is now, to a significant extent, the 'New Labour constitution'. The book takes a broad approach to exploring the legacy of the New Labour years for the UK constitution. The contributors evaluate a range of specific substantive reforms (including on human rights, devolution, freedom of information, and the judicial system), changes to the process and method of constitutional reform under New Labour, the impact on key institutions (such as the judiciary and Parliament), and a number of wider constitutional themes (including national security, administrative justice, and the relationship between the Labour Party and constitutionalism). The book also reflects on the future challenges for the constitution constructed by New Labour, and the prospects for further constitutional reform. In bringing together this range of perspectives to reflect on the implications of the New Labour era of reform, this book offers a critical examination of a foundational period in the development of the contemporary UK constitution.

The constitution is the foundation upon which law and government are built. Yet the United Kingdom has no agreed process for constitutional change. The Committee does not accept that the government should be able to pick and choose which processes to apply when proposing significant constitutional change. It therefore recommends in this report the adoption of a clear and consistent process. These recommendations are not intended to restrict the government's right to initiate constitutional change, but to hold ministers to account for their decisions. The Committee regard it as essential that, prior to the introduction of a bill which provides for significant constitutional change, the government considers the impact of the proposals upon the existing constitutional arrangements, subject the proposals to detailed scrutiny in the Cabinet and its committees, consult widely, publish green and white papers, and subject the bill to pre-legislative scrutiny. The Committee looks at these processes in this report, as well as considering the desirability of public engagement and building consensus. Also the importance of not rushing parliamentary scrutiny of legislation once introduced into Parliament and of conducting comprehensive post-legislative scrutiny of significant constitutional legislation once passed. Also recommended is the minister responsible for a significant constitutional bill in each House set out the processes to which a bill has been subjected in a written ministerial statement. This comprehensive package from which the government should depart only in exceptional circumstances and where there are clearly justifiable reasons for so doing. The Committee believes this approach is pragmatic and achievable, enabling the flexibility of the United Kingdom's current constitutional arrangements to be retained whilst enhancing and underpinning those arrangements

When New Labour came to power in 1997, its leaders asked for it to be judged after ten years on its success in making Britain 'a more equal society'. As it approaches the end of an unprecedented third term in office, this book asks whether Britain has indeed moved in that direction. The highly successful earlier volume A more equal society? was described by Polly Toynbee as the LSE's mighty judgement on inequality. Now this second volume by the same team of authors provides an independent assessment of the success or otherwise of New Labour's policies over a longer period. It provides: · consideration by a range of expert authors of a broad set of indicators and policy areas affecting poverty, inequality and social exclusion; · analysis of developments up to the third term on areas including income inequality, education, employment, health inequalities, neighbourhoods, minority ethnic groups, children and older people; · an assessment of outcomes a decade on, asking whether policies stood up to the challenges, and whether successful strategies have been sustained or have run out of steam; chapters on migration, social attitudes, the devolved administrations, the new Equality and Human Rights Commission, and future pressures. The book is essential reading for academic and student audiences with an interest in contemporary social policy, as well as for all those seeking an objective account of Labour's achievements in power.
