Lord Carlile is the Independent Reviewer of Counter Terrorism legislation. In this document he examines the range of proposals contained in the two consultation documents, 'Possible Measures for Inclusion in a Future Counter Terrorism Bill' and 'Options fro Pre-Charge Detention in Terrorist Cases', published on 25th July 2007. His overall conclusion is that the proposed measures are useful and relatively uncontroversial, apart from the proposal for a longer period of detention between arrest and charge, use of intercept evidence and enhanced sentences. Of these a prolonged and heated debate is likely on the detention issue, which he hopes will be decided by Parliament on its merits rather than by division on party lines.

This inquiry concentrates on the proposal to extend the right of police to detain suspects, without charge, for longer than 28 days. The overall conclusion is that neither the Government nor the police have made a convincing case that the current limit is inadequate. After considering a proposal, from Liberty, that Part 2 of the Civil Contingencies Act (CCA) 2004 could be used in exceptional circumstances, the Committee conclude it would not be sensible to trigger a national state of emergency in the middle of an investigation. They therefore recommend that the Government seek agreement for the reform of the CCA to secure Parliamentary scrutiny and judicial oversight without the need for a state of emergency. Other recommendations from this report include; allowing the use of intercept evidence in court; allowing the police to question suspects after charge; and that inferences could be drawn from any refusal by suspects to answer such questions.

This report examines the Government's intention, as part of its counter-terrorism measures, to increase the pre-charge detention limit from 28 to 42 days. The Committee believes that there is a clear national consensus that the case for further change has not been made by the Government. In the Committee's view a truly consensual approach should lead the Government to accept that it has failed to build the necessary national consensus for this very significant interference with the right to liberty and withdraw the proposal; to proceed with it as detailed by the Home Office calls into question the Government's commitment to a consensual approach and raises questions of compatibility with human rights. The Committee does not accept that the Government has made the case for extending pre-charge detention beyond the current limit of 28 days, for the following reasons: i) it can find no clear evidence of likely need in the near future; ii) alternatives to extension do enough, in combination, to protect the public and are much more proportionate; iii) the proposed parliamentary mechanism would create a serious risk of prejudice to the fair trial of suspects; iv) the existing judicial safeguards for extensions even up to 28 days are inadequate.
