Not illustrated. 1901 edition. Excerpt: ...in the English Courts, and I think the same rule applies to a cheque under the circumstances of this case. There is another question: By Austrian law the Vienna bank took a good title only if it took the cheque in good faith and for full value (about which there is no dispute), and also without gross negligence. The gross negligence relied on is this-that the Vienna bank did not make further inquiries as to the stranger who brought the cheque to the bank to be cashed. That is one point which is relied upon, and I will deal with that first. They did inquire of the drawer of the cheque to ascertain whether the cheque was a genuine cheque---whether it was really acheque drawn by the drawer on the bank in London. They found out that it was. Who the person was into whose hands the cheque had got they could not tell at all except by asking him, and it seems to me that that would have been a very useless proceeding because he could have said anything he chose; and I do not think that they could expect to be able to obtain any reasonable security as to the validity of the transaction, or as to the identity of the person who presented the cheque to them, by making inquiries of him. At any rate the fact that they did not make any further inquiry than they did does not seem to amount to what the Austrian law calls gross negligence. Then the other point is this: It is said that the cheque W115 indorsed to Gr. Embiricos & Co., and that G. Embiricos &. Co. were in London. But there was nothing on the face of the cheque to show they were in London. It did not say " of London," although in fact they were of London; so that there was nothing to show that (jr. Embiricos & Co., to whom the cheque was indorsed, were reallll in London....
