Intellectual Property and Health Technologies Balancing Innovation and the Public's Health Joanna T. Brougher, Esq., MPH At first glance, ownership of intellectual property seems straightforward: the control over an invention or idea. But with the recent explosion of new scientific discoveries poised to transform public health and healthcare systems, costly and lengthy patent disputes threaten both to undermine the attempts to develop new medical technologies and to keep potentially life-saving treatments from patients who need them. Intellectual Property and Health Technologies grounds readers in patent law and explores how scientific research and enterprise are evolving in response. Geared specifically to the medical disciplines, it differentiates among forms of legal protection for inventors such as copyrights and patents, explains their limits, and argues for balance between competing forces of exclusivity and availability. Chapters delve into the major legal controversies concerning medical and biotechnologies in terms of pricing, markets, and especially the tension between innovation and access, including: The patent-eligibility of genes The patent-eligibility of medical process patents The rights and roles of universities and inventors The balancing of access, innovation, and profit in drug development The tension between biologics, small-molecule drugs, and their generic counterparts International patent law and access to medicine in the developing world As these issues continue to shape and define the debate, Intellectual Property and Health Technologies enables professionals and graduate students in public health, health policy, healthcare administration, and medicine to understand patent law and how it affects the development of medical technology and the delivery of medicine.

Biomaterials In Clinical Practice written by Fatima Zivic and has been published by Springer this book supported file pdf, txt, epub, kindle and other format this book has been release on 2018-09-01 with Technology & Engineering categories.

This book covers the properties of biomaterials that have found wide clinical applications, while also reviewing the state-of-the-art in the development towards future medical applications, starting with a brief introduction to the history of biomaterials used in hip arthroplasty. The book then reviews general types of biomaterials – polymers, ceramics, and metals, as well as different material structures such as porous materials and coatings and their applications – before exploring various current research trends, such as biodegradable and porous metals, shape memory alloys, bioactive biomaterials and coatings, and nanometals used in the diagnosis and therapy of cancer. In turn, the book discusses a range of methods and approaches used in connection with biomaterial properties and characterization – chemical properties, biocompatibility, in vivo behaviour characterisation, as well as genotoxicity and mutagenicity – and reviews various diagnostic techniques: histopathological analysis, imagining techniques, and methods for physicochemical and spectroscopic characterization. Properties of stent deployment procedures in cardiovascular surgeries, from aspects of prediction, development and deployment of stent geometries are presented on the basis of novel modelling approaches. The last part of the book presents the clinical applications of biomaterials, together with case studies in dentistry, knee and hip prosthesis. Reflecting the efforts of a multidisciplinary team of authors, gathering chemical engineers, medical doctors, physicists and engineers, it presents a rich blend of perspectives on the application of biomaterials in clinical practice. The book will provide clinicians with an essential review of currently available solutions in specific medical areas, also incorporating non-medical solutions and standpoints, thus offering them a broader selection of materials and implantable solutions. This work is the result of joint efforts of various academic and research institutions participating in WIMB Tempus project, 543898-TEMPUS-1-2013-1-ES-TEMPUS-JPHES, "Development of Sustainable Interrelations between Education, Research and Innovation at WBC Universities in Nanotechnologies and Advanced Materials where Innovation Means Business", co-funded by the Tempus Programme of the European Union.

Reaping The Benefits Of Genomic And Proteomic Research written by National Research Council and has been published by National Academies Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2006-03-09 with Science categories.

The patenting and licensing of human genetic material and proteins represents an extension of intellectual property (IP) rights to naturally occurring biological material and scientific information, much of it well upstream of drugs and other disease therapies. This report concludes that IP restrictions rarely impose significant burdens on biomedical research, but there are reasons to be apprehensive about their future impact on scientific advances in this area. The report recommends 13 actions that policy-makers, courts, universities, and health and patent officials should take to prevent the increasingly complex web of IP protections from getting in the way of potential breakthroughs in genomic and proteomic research. It endorses the National Institutes of Health guidelines for technology licensing, data sharing, and research material exchanges and says that oversight of compliance should be strengthened. It recommends enactment of a statutory exception from infringement liability for research on a patented invention and raising the bar somewhat to qualify for a patent on upstream research discoveries in biotechnology. With respect to genetic diagnostic tests to detect patient mutations associated with certain diseases, the report urges patent holders to allow others to perform the tests for purposes of verifying the results.

Promoting Access To Medical Technologies And Innovation written by Anatole F. Krattiger and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2012 with Biomedical engineering categories.

Medical technologies - medicines vaccines and medical devices - are essential for public health. Access to essentialmedicines and research to address neglected diseases have been a major concern for many years. Morerecently the focus of health policy debate has broadened to consider how to promote innovation and how to ensureequitable access to all vital medical technologies. Today's health policy-makers need a clear understanding both of the innovation processes that lead to new technologiesand of the ways in which these technologies are disseminated in health systems. This study seeks to reinforce theunderstanding of the interplay between the distinct policy domains of health trade and intellectual property and of how theyaffect medical innovation and access to medical technologies. It captures a broad range of experience and data in dealingwith the interplay between intellectual property trade rules and the dynamics of access to and innovation in medicaltechnologies. A collaborative effort by the World Health Organization the World Intellectual Property Organization and theWorld Trade Organization draws together the three Secretariats respective areas of expertise. The study is intended to inform ongoing technical cooperation activities undertaken by the three organizations and tosupport policy discussions. Based on many years of field experience in technical cooperation the study has been preparedto serve the needs of policy-makers who seek a comprehensive presentation of the full range of issues as well aslawmakers government officials delegates to international organizations non-governmental organizations and researchers.

Intellectual Property And Public Health In The Developing World written by Monirul Azam and has been published by Open Book Publishers this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-05-30 with Law categories.

Across the world, developing countries are attempting to balance the international standards of intellectual property concerning pharmaceutical patents against the urgent need for accessible and affordable medicines. In this timely and necessary book, Monirul Azam examines the attempts of several developing countries to walk this fine line. He evaluates the experiences of Brazil, China, India, and South Africa for lessons to guide Bangladesh and developing nations everywhere. Azam's legal expertise, concern for public welfare, and compelling grasp of principal case studies make Intellectual Property and Public Health in the Developing World a definitive work. The developing world is striving to meet the requirements of the World Trade Organization's TRIPS Agreement on intellectual property. This book sets out with lucidity and insight the background of the TRIPS Agreement and its implications for pharmaceutical patents, the consequences for developing countries, and the efforts of certain representative nations to comply with international stipulations while still maintaining local industry and public health. Azam then brings the weight of this research to bear on the particular case of Bangladesh, offering a number of specific policy recommendations for the Bangladeshi government—and for governments the world over. Intellectual Property and Public Health in the Developing World is a must-read for public policy-makers, academics and students, non-governmental organizations, and readers everywhere who are interested in making sure that developing nations meet the health care needs of their people.
