"China has an image as a realm of Oriental despotism where law is at best window-dressing and at worst an instrument of coercion and tyranny. The rule of law seems an elusive ideal in the face of entrenched obstacles baked, as it were, into China's cultural and political DNA. In this highly original contribution to the interdisciplinary field of law and humanities, Haiyan Lee contends that this image arises from an ahistorical understanding of China's political-legal tradition, particularly the failure to distinguish what she calls high justice and low justice. Lee argues that the liberal (and, so to speak, horizontal) conception of justice as fairness is quite different from the Chinese understanding of law. In the Chinese legal imagination, she shows, justice is a vertical concept, with low justice between individuals firmly subordinated to the high justice of the state. China's political-legal culture mistrusts law's ability to deliver justice and privileges moral over procedural justice. Lee shows that Chinese literature and film invariably dramatize the relationship between law and morality in ways that emphasize law's concession to moral sentiments and the triumph of moral justice through the discretion of a sagacious judge or the defiance of a vigilante hero. As China rises to global superpower status, its conception of justice can no longer be treated as a pale, floundering, and negligible sideshow to the legal drama of defending liberty and upholding human rights in the West. Lee's book helps us recognize the fight for justice outside the familiar arenas of liberal democracy and in terms other than those furnished by the rule of law"--

This book is the first to offer a justice-focused cognitive reading of modern YA speculative fiction in its narrative and filmic forms. It links the expansion of YA speculative fiction in the 20th century with the emergence of human and civil rights movements, with the communitarian revolution in conceptualizations of justice, and with spectacular advances in cognitive sciences as applied to the examination of narrative fiction. Oziewicz argues that complex ideas such as justice are processed by the human mind as cognitive scripts; that scripts, when narrated, take the form of multiply indexable stories; and that YA speculative fiction is currently the largest conceptual testing ground in the forging of justice consciousness for the 21st century world. Drawing on recent research in the cognitive and evolutionary sciences, Oziewicz explains how poetic, retributive, restorative, environmental, social, and global types of justice have been represented in narrative fiction, from 19th century folk and fairy tales through 21st century fantasy, dystopia, and science fiction. Suggesting that the appeal of these and other nonmimetic genres is largely predicated on the dream of justice, Oziewicz theorizes new justice scripts as conceptual tools essential to help humanity survive the qualitative leap toward an environmentally conscious, culturally diversified global world. This book is an important contribution to studies of children’s and YA speculative fiction, adding a new perspective to discussions about the educational as well as social potential of nonmimetic genres. It demonstrates that the justice imperative is very much alive in YA speculative fiction, creating new visions of justice relevant to contemporary challenges.

English law underwent rapid transformation in the sixteenth century, in response to the Reformation and also to heightened litigation and legal professionalization. As the common law became more comprehensive and systematic, the principle of jurisdiction came under particular strain. When the common law engaged with other court systems in England, when it encountered territories like Ireland and France, or when it confronted the ocean as a juridical space, the law revealed its qualities of ingenuity and improvisation. In other words, as Bradin Cormack argues, jurisdictional crisis made visible the law’s resemblance to the literary arts. A Power to Do Justice shows how Renaissance writers engaged the practical and conceptual dynamics of jurisdiction, both as a subject for critical investigation and as a frame for articulating literature’s sense of itself. Reassessing the relation between English literature and law from More to Shakespeare, Cormack argues that where literary texts attend to jurisdiction, they dramatize how boundaries and limits are the very precondition of law’s power, even as they clarify the forms of intensification that make literary space a reality. Ecological causes are championed not only by lobbyists or hikers. While mainstream environmentalism is usually characterized by well-financed, highly structured organizations operating on a national scale, campaigns for environmental justice are often fought by poor or minority communities. Environmentalism and Economic Justice is one of the first books devoted to Chicano environmental issues and is a study of U.S. environmentalism in transition as seen through the contributions of people of color. It elucidates the various forces driving and shaping two important examples of environmental organizing: the 1965-71 pesticide campaign of the United Farm Workers and a grazing conflict between a Hispano cooperative and mainstream environmentalists in northern New Mexico. The UFW example is one of workers highly marginalized by racism, whose struggle--as much for identity as for a union contract--resulted in boycotts of produce at the national level. The case of the grazing cooperative Ganados del Valle, which sought access to land set aside for elk hunting, represents a subaltern group fighting the elitism of natural resource policy in an effort to pursue a pastoral lifestyle. In both instances Pulido details the ways in which racism and economic subordination create subaltern communities, and shows how these groups use available resources to mobilize and improve their social, economic, and environmental conditions. Environmentalism and Economic Justice reveals that the environmental struggles of Chicano communities do not fit the mold of mainstream environmentalism, as they combine economic, identity, and quality-of-life issues. Examination of the forces that create and shape these grassroots movements clearly demonstrates that environmentalism needs to be sensitive to local issues, economically empowering, and respectful of ethnic and cultural diversity.

This edited volume unites the fields of energy justice and comparative philosophy to provide an overarching global perspective and approach to applying energy ethics.
