La democracia constitucional solo puede articularse a través de la representación, nada impide, sin embargo, que sea complementada, aunque nunca sustituida, con algunas instituciones de democracia directa o participativa, como excepción a la regla general de la democracia representativa. La profunda crisis económica y la consecuente puesta en peligro de algunos de los logros del Estado de bienestar son el caldo de cultivo perfecto para aumentar la distancia entre los ciudadanos y el poder político. Por ende, la institución parlamentaria constituye el eje medular alrededor del cual gira la «crisis de la representación».En aras a abordar dichas consideraciones, esta monografía se inicia con una rigurosa reflexión sobre la crisis de la representación. En el marco del cuestionamiento que rodea a la representatividad del Parlamento incide, de manera notable, la preponderancia que ha adquirido el Ejecutivo frente al Legislativo, que ha acumulado funciones y tareas de las que desposee al poder legislativo, como si el monopolio de la política terminara uniendo los poderes que tanto costó separar.Asimismo, se plantea el carácter irrenunciable de la democracia representativa y su articulación en torno a la institución del Parlamento de manera que se analiza minuciosamente las funciones parlamentarias, afrontándose la necesidad de adecuar las tareas que tradicionalmente se le han atribuido (legislar, controlar y aprobar los presupuestos) a un contexto actual en el que se exige la acomodación de las mismas a los retos y demandas de los ciudadanos en la sociedad digital. Igualmente, se propone la introducción de modernas atribuciones, bien ancilares de las anteriores, como la incorporación de las TIC a la potenciación de la participación, o, funciones ex novo, como la función integradora y la pedagógica.Como colofón, se emprende el estudio de los mecanismos de participación vigentes en el ordenamiento jurídico español a fin de plantear una sugestiva reflexión, crítica y razonada, acerca de la introducción de eventuales reformas legislativas para asegurar una participación de los ciudadanos, viable y compatible, en una democracia esencialmente representativa. En esta línea, se hacen propuestas de lege ferenda relativas a los principales problemas a los que se enfrenta nuestro país y circunscritas a la incorporación de nuevas vías de participación conciliables con la democracia representativa fundamentalmente vinculadas con la Revolución Digital, la reforma de los instrumentos de participación previstos en la Constitución Española y la integración de mecanismos trasladados desde el derecho comparado como las Convenciones Constitucionales.

It is becoming common in many states: the opportunity to reclaim government from politicians by simply signing a petition to put an initiative on the ballot and then voting for it. Isn't this what America ought to be about? Proposition 13 in California's 1978 election paved the way; the past decade saw more than 450 such actions; now in many states direct legislation dominates the political agenda and defines political—and public-opinion. While this may appear to be democracy in action, Richard Ellis warns us that the initiative process may be putting democracy at risk. In Democratic Delusions he offers a critical analysis of the statewide initiative process in the United States, challenging readers to look beyond populist rhetoric and face political reality. Through engaging prose and illuminating (and often amusing) anecdotes, Ellis shows readers the "dark side" of direct democracy—specifically the undemocratic consequences that result from relying too heavily on the initiative process. He provides historic context to the development of initiatives-from their Populist and Progress roots to their accelerated use in recent decades-and shows the differences between initiative processes in the states that use them. Most important, while acknowledging the positive contribution of initiatives, Ellis shows that there are reasons to use them carefully and sparingly: ill-considered initiatives can subvert normal legislative checks and balances, undermine the deliberative process, and even threaten the rights of minority groups through state-sanctioned measures.
