Este libro es el producto de las investigaciones de 2015 que se socializaron en el Congreso Nacional Retos y Perspectivas de la Política Criminal. La primera parte del libro la hemos denominado "Pluralismo y política criminal'; en ella se contemplan los siguientes capítulos: "Procesamiento intercultural de disputas en una comunidad guaraya': Este analiza la tradicional relación de inequidad existente en Latinoamérica entre los órdenes legales indígenas y los estatales. "Política criminal y pluralismo en Colombia" indaga el porqué del desconocimiento de la jurisdicción indígena en la colisión de jurisdicciones; "Aproximación a la cárcel agrícola de Kassavetia" explica la importancia del estudio de las cárceles agrícolas; y Pluralismo en los centros penitenciarios italianos:la población musulmana en la cárcel de Verona" presenta la situación de esta población carcelaria en Europa. La segunda parte del libro la hemos denominado "Política Criminal, mujer y derechos humanos”, en ella se encuentran los siguientes capítulos: "La necesidad de una política criminal en materia de drogas que reconozca la situación de vulnerabilidad que enfrenta la mujer"; "Femininity and 'Memory' in Disarmament, Demobilisation, and Reintegration Programmes" destaca los procesos de desarme, desmovilización, y reintegración de las mujeres excombatientes en Colombia; y "Prisión dentro de la prisión. Unidades de tratamiento especial: privación de derechos" analiza cómo estas unidades ocasionan una pena privativa más severa que la impuesta al momento de la comisión del delito.

Este libro es el resultado de las investigaciones realizadas durante el año 2019 promovidas por la Red de Investigadores del Centro de Investigación en Política Criminal de la Universidad Externado de Colombia, presentadas en el Congreso internacional: "Pluralismo jurídico, derechos humanos y perspectivas críticas de la política criminal\'; en el cual se presentaron las distintas expresiones materiales y formales del pluralismo jurídico en Colombia a la luz de la política criminal. La primera parte de esta publicación pretende generar reflexiones a partir del estudio de casos sobre la formación de las identidades discursivas en prisión desde la experiencia de la población privada de la libertad y la incidencia de las percepciones de actores externos, como los medios de comunicación. En una segunda parte, se establecen diálogos basados en el pluralismo entre los distintos sistemas de justicia existentes, como la jurisdicción indígena, la Jurisdicción Especial para la Paz (JEP), la jurisdicción ordinaria y el sistema de justicia de responsabilidad penal adolescente. Finalmente, este libro busca visibilizar la necesidad de incorporar el enfoque de interseccionalidad en la política criminal con el objetivo de movilizar las agendas de política pública hacia la garantía de los derechos humanos de población en condición de vulnerabilidad, como las mujeres privadas de la libertad y las personas transgénero. En este sentido, las reflexiones aquí contenidas es pe ran generar eco en los distintos tomadores de decisiones de las ramas Ejecutiva, Judicial y Legislativa, a fin de que el pluralismo jurídico material en Colombia sea una garantía para el ejercicio de los derechos humanos y permita transitar hacia escenarios de diversidad, inclusión y reconocimiento en la política criminal.

Female Ex-Combatants, Empowerment, and Reintegration investigates the role of United Nations-led Disarmament, Demobilization, and Reintegration (DDR) programs in undermining female ex-combatants’ empowerment. The participation of female combatants in conflict has increasingly been recognized in feminist literatures and in policies and programs concerned with reintegrating ex-combatants and building peace. This has illustrated that female ex-combatants often experience "empowerment" through their role as combatant; however, this empowerment is often lost upon reintegration. UN-led DDR plays an important role in the broader peacebuilding process, as it is one of the largest interventions and directly aims to reintegrate ex-combatants into civilian life. This book draws on extensive field research and interviews with female ex-combatants and DDR officials in Liberia and Nepal to develop a nuanced and comprehensive picture of female ex-combatants’ empowerment and how this is undermined by DDR. Through reconceptualized frameworks of empowerment and an emancipatory peace, the book explores the pivotal role that DDR programs play in undermining female ex-combatants’ empowerment. The author argues that this is detrimental to peacebuilding, because DDR officials and documentation narrate female ex-combatants in limited and gendered ways, which reproduces gendered inequalities and define how female ex-combatants should behave. Esta publicación es el resultado de las investigaciones realizadas, durante el 2022, promovidas por la Red de Investigadores del Centro de Investigación en Política Criminal de la Universidad Externado de Colombia y presentadas en el congreso internacional "Del retribucionismo hacia una cultura de la convivencia". Esta publicación pretende, por un lado, generar reflexiones sobre los aportes de las justicias propias a la justicia restaurativa desde una perspectiva intercultural; de ahí la necesidad de supe-rar el retribucionismo según el cual la víctima y el ofensor tienen pocas posibilidades de encuentro para la expresión de las necesidades causadas por el daño y el reconocimiento del mismo. Por otro lado, busca acercar a los y las lectoras a ejemplos de justicia restaurativa dentro del sistema judicial penal y a iniciativas de prevención, como parte de la política social que permite la reducción de las violencias, la disminución del uso del sistema penal y el mejoramiento de las condiciones de vida, especial-mente de la población juvenil.
