Le Royaume-Uni est le cinquième pays mondial en termes de produit intérieur brut et un acteur économique incontournable. Son système financier, qui est le plus ancien parmi les démocraties occidentales, a inspiré de nombreux pays, au premier rang desquels les États-Unis, le Canada, l’Australie, la Nouvelle-Zélande et la République d’Irlande, qui ont tous reçu en héritage les règles, les procédures et les concepts imaginés à Londres. Pendant qu’il était membre des Communautés puis de l’Union européenne, le Royaume-Uni a su préserver la singularité d’un système marqué par une grande centralisation. Mais le processus de dévolution engagé à partir de 1997 a entraîné des adaptations au profit des autorités dévolues dont les revendications ont été exacerbées par la sortie de l’Union européenne. Le présent ouvrage offre un aperçu d’ensemble des finances publiques du Royaume-Uni. Après une introduction présentant l’originalité du modèle, l’ouvrage se compose de quatre parties. La première partie porte sur le cadre juridique du système financier et examine les principes budgétaires, l’histoire, les sources juridiques et les acteurs des finances publiques. La deuxième partie traite des finances du gouvernement central, avec une présentation de l’élaboration des demandes budgétaires et de leur vote par le Parlement, ainsi qu’une analyse des processus d’exécution, de contrôle et d’audit. La troisième partie est consacrée aux finances locales, c’est-à-dire celles des autorités dévolues (Écosse, pays de Galles et Irlande du Nord) et celles des autorités locales infrarégionales (conseils locaux). Enfin, la quatrième partie aborde la relation financière entre le Royaume-Uni et l’Union européenne et sa nécessaire redéfinition en raison du Brexit.

The recently enacted Treaty on the Stability, Coordination and Governance of the Economic and Monetary Union (generally referred to as the Fiscal Compact) has introduced a 'golden rule', which is a detailed obligation that government budgets be balanced. Moreover, it required the 25 members of the EU which signed the Treaty in March 2012, to incorporate this 'golden rule' within their national Constitutions. This requirement represents a major and unprecedented development, raising formidable challenges to the nature and legitimacy of national Constitutions as well as to the future of the European integration project. This book analyses the new constitutional architecture of the European Economic and Monetary Union (EMU), examines in a comparative perspective the constitutionalization of budgetary rules in the legal systems of the Member States, and discusses the implications of these constitutional changes for the future of democracy and integration in the EU. By combining insights from law and economics, comparative institutional analysis and legal theory, the book offers a comprehensive survey of the constitutional incorporation of new fiscal and budgetary rules across Europe and a systematic normative discussion of the legitimacy issues at play. This book presents the results of extensive international comparative research into the effects of the economic and financial crisis on democratic institutions and social cohesion policies. The collected studies describe and analyse the measures (often referred to as "reforms") adopted to counter the crisis and the effects of these measures.It investigates three areas: the impact on the functioning of institutions, with respect to the relationship between representative institutions and governments, and the organisational structure of administrations at national and local levels; the impact that the austerity policies on public spending have on social rights; and the impact on traditional instruments of public action (administrative simplification, public services delivering, the use of common assets).The general findings highlight the effect of reducing the administrative and government capacity of the democratic institutions: the public sector, rather than being innovative and made more effective, declines, offering increasingly poor public services and making bad decisions, fuelling substantive or formal privatisation solutions, which in turn cause further weakening.
