After Algeria’s president Abdelaziz Bouteflika announced his intention to run for a fifth term in early 2019, a popular peaceful uprising erupted calling for change. Bouteflika, who had been in office since 1999, was eventually forced to resign, but the Hirak (“movement”) continued to protest the country’s inequalities and entrenched ruling elite. The Suspended Disaster examines the dynamics of the Algerian political system, offering new insights into the last years of Bouteflika’s rule and the factors that shaped the emergence of an unexpected social movement. Thomas Serres argues that the Algerian ruling coalition developed a mode of government based on the management of a seemingly never-ending crisis, marked by an obsession with security and the ever-present possibility of unrest, violence, and economic collapse. Identifying this form of rule as “governance by catastrophization,” he shows how attempts to preserve the status quo through emergency policies and constant reforms can also lay the groundwork for a revolutionary situation. Serres contrasts the government’s portrayal of perpetually imminent disaster with the uncertainty, precarity, and indignity experienced by much of the population, which fueled the rejection of ruling elites, a profound mistrust toward institutions, and new spaces for grassroots opposition. Based on extensive fieldwork and theoretically novel, The Suspended Disaster sheds new light on the political, economic, and social processes underlying an uprising that changed the face of Algerian politics.

Economic Analysis of the Arbitrator’s Function Bruno Guandalini Arbitration has become an important market, where arbitrators are rational economic agents maximizing their utility. Although this is self-evident, it is rarely discussed. This penetrating book is the first to comprehensively analyze the market for arbitrators and arbitrators’ economic role within it. In great depth, the author tackles such salient issues as the following: effect of perceived inefficiencies and high costs on arbitration legitimacy; alleged commercialization of the arbitrator’s function; possible ethical problem raised by financial remuneration for rendering justice; what motivates a person to arbitrate; market for arbitrators’ functioning and failures, providing a better understanding of how actors could behave in such a specific market; structural and artificial entry barriers; effect of an arbitrator’s strategic behavior on the arbitrator’s function; limitations on an arbitrator’s rationality; and preventing and correcting these limitations. This book examines the largely neglected but crucial role of transnational actors in democratic constitution-making. The writing or rewriting of constitutions is usually a key moment in democratic transitions. But how exactly does this take place? Most contemporary comparative constitutional literature draws on the concept of constituent power – the power of the people – to address this moment. But what this overlooks, this book argues, is the important role of external, transnational actors who tend to play a crucial role in the process. Drawing on sociolegal methodologies but informed by new legal realism, this book develops a new theoretical framework for examining the involvement of such actors in constitution-making. Empirically grounded, the book uncovers a more comprehensive picture of how constitution-making unfolds on the ground. Illuminating the power dynamics at play during the legal process, it reveals not only the wide range of external actors involved but also the continuity between decolonisation and post-Cold War constitution-making. This book addresses sixteen different reform proposals that are urgently needed to correct the fault lines in the international tax system as it exists today, and which deprive both developing and developed countries of critical tax resources. It offers clear and concrete ideas on how the reforms can be achieved and why they are important for a more just and equitable global system to prevail. The key to reducing the tax gap and consequent human rights deficit in poor countries is global financial transparency. Such transparency is essential to curbing illicit financial flows that drain less developed countries of capital and tax revenues, and are an impediment to sustainable development. A major break-through for financial transparency is now within reach. The policy reforms outlined in this book not only advance tax justice but also protect human rights by curtailing illegal activity and making available more resources for development. While the reforms are realistic they require both political and an informed and engaged civil society that can put pressure on governments and policy makers to act.
