Life can be surprising. From this point on my life’s journey, I look back, and it almost seems surreal. As I gaze through that long traveled pathway of time, I can honestly say that had I had a chance at the beginning to glimpse forward to see where this traveled road would take me, I wouldn’t have believed it. And so, this is probably true for a lot of us in my generation. We were born into a time of change, significant change. The kind of change that would set our lives and those of the following generations apart from those of just one generation ahead of us. The previous generations secured our future. They paid for it with their personal sacrifice and unrivaled bravery. That future has also served to make the world a smaller place, whether it be by audio and video communications, computers, or the commonplace of jet travel. As part of this “new” world, I have gone on to see and do things that seemed to be out of reach from that generational point where I entered this life. As I have reached the more “senior” years of my life, I have found the temptation to document a lot of life’s little adventures, or “misadventures” as they may be. I am also responding to those many people who have said “you should write a book”. The technology of today has also made this temptation easy and practical to implement. This book is my first pass at this endeavor, at least in the non-technical realm. The subject matter was an easy choice. The events covered in this book affected many things in many ways. These effects include both future generations and the geographical aspects of the regions involved. More importantly, this story, at least in part, shares common elements with many other people and communities. In some cases, these same things are occurring right now, in probably very similar circumstances. This book just may provide helpful insight to others who now stand where we once stood. Many Australians believe that there is still hope. There may be a prospect of future constitutional change but not with the process that was adopted and not with the wording that was proposed in 2023. It's time to begin the conversation about past mistakes, before we all start forgetting what went on. The major challenge for the country in the future will be according First Australians agency and self-determination while remaining true to the undoubted rules for constitutional change. Indigenous leaders will not accept minimal symbolic change to the Constitution. Good process can yield good policy, which can produce good politics, which might then result in a popular positive referendum result. Frank Brennan was a member of the Calma/Langton committee that guided the Co-Design process to develop options for an Indigenous voice to parliament. He has previously published three books on Indigenous constitutional recognition: Sharing the Country (Penguin Books, two editions, 1992 and 1994); No Small Change: The Road to Recognition for Indigenous Australia (University of Queensland Press, 2015); and An Indigenous Voice to Parliament: Considering a Constitutional Bridge (Garratt Publishing, 2023, three editions). During the 2023 referendum campaign, he addressed many public meetings and worked closely with the National Aboriginal and Torres Strait Islander Catholic Council.

It offers an alternative theory of referendums whereby they are one of many ordinary ways that voters give direction to their representatives. In this way, the book argues that referendums are better understood as exercises in representative democracy. The book challenges the current treatment of referendums in processes of constitutional change both in the UK and around the world. It argues that referendums have been used under the banner of popular sovereignty in a way that undermines representative institutions. This book makes the case for the use of referendums stronger by showing how they can support, rather than undermine, institutions of representative democracy. Understanding referendums as exercises in representative democracy has broader implications for constitutional democracy as well. Rather than see the power to constitute constitutions as something that happens occasionally in exceptional moments through referendums, this book argues instead that voters constantly have the power to constitute and reconstitute their constitutions.
