Abstract: Abstract of dissertation entitled "A Study of Road Traffic Accidents in Relation to Public Light Bus Driving Behaviour in Hong Kong" Submitted by Wong Chi Wing Andy For the degree of Master of Arts in Transport Policy and Planning at The University of Hong Kong in June 2006 The objectives of this study are to investigate the driving behaviour of the drivers of public light buses (PLB) in relation to their demographic information, and the effectiveness of enforcement penalty on their driving behaviour. Self-administered mail-back questionnaires were distributed to PLB drivers of red minibuses (RMB) and green minibuses (GMB) to collect the required information and their views on the use of demerit points and fiscal penalties against the traffic offences of red light jumping and speeding. The response rate was 34.4%. Multinomial logit model and Watson and Westin Pooling Tests were then applied for the data analysis Results of the analysis indicated that the enforcement penalty had a positive effect on the driving behaviour of a certain demographic group of PLB drivers. The change in penalty level has a deterrent effect in changing the drivers' behaviour. For red light jumping, the increase in penalty has a greater deterrent effect on the drivers of GMB than that of RMB. For speeding, the increase in penalty slows down many drivers, but not all when passing the locations with cameras. To gradually change the driving mis-behaviour of PLB drivers, education shall be one of the effective measures to heighten the road safety awareness and the sense of accountability and responsibility for the community of PLB drivers. This dissertation, "The Deterrent Effect of Drug Driving Laws in Hong Kong: a Multi-dimensional Analysis" by Yiu-wai, Chan, Tsun-yu, Cheung, Sau-lan, Law, Chiu-hang, Yau, Yu-sing, Alex, Yau, 張晉宇, 羅秀蘭, 邱招恆, 邱雨星, 陳耀偉, was obtained from The University of Hong Kong (Pokfulam, Hong Kong) and is being sold pursuant to Creative Commons: Attribution 3.0 Hong Kong License. To tackle the seemingly increasing road hazards, the Hong Kong SAR government considered the urgent need to provide enforcement measures against drug driving offences. The Road Traffic Ordinance (Cap. 374) was amended in 2011 and issues relating to illicit drugs under the amended ordinance will be discussed in detail in this research paper. This thesis serves as a pioneer study on this topic in Hong Kong that could also provide a path and direction for professionals when it comes to the evaluation of the legislation in the future. The purpose of this paper is to evaluate, through in-depth interviews and survey questionnaires, the effectiveness of this legislation from different aspects such as the deterrent effect on drug drivers, the effect in changing the driving behaviour of road users, and the practicality of being a useful tool in combating drug driving by law enforcement agencies. This research contains in-depth interviews of the stakeholders such as persons with drug experience, police officers, social workers and the comments of the general public on drug driving legislation through questionnaires. In addition, comparisons between jurisdictions of various countries will be discussed. The analysis of the research findings indicates that people in Hong Kong welcomed the legislation because they believed it could deter potential drug driving offences. Also, the new legislation offers police officers the legitimate power to collect evidence from drivers suspected of driving under the influence of drugs. However, the public's knowledge of the content and punishments regarding this legislation is considered to be moderate at best. Furthermore, those with drug experience consider that this legislation will indeed not have much impact on drug driving. It is anticipated that the government will need to devote more resources to promoting public awareness of the concerned legislation. The criminal law on serious traffic offenses presents legislators with numerous controversial issues. One such issue is when severe consequences are matched with low moral culpability. How should the law deal with a driver who kills someone because she failed to see the person when looking? Another controversial issue concerns highly culpable behavior that remains without serious consequences. How should the law cope with a driver who nearly kills someone when overtaking recklessly? The traffic context generates many hard cases that call the outermost boundaries of general doctrinal concepts like intent, negligence, or causation into question. This book contains an international collection of essays on criminal liability for serious traffic offenses. With a focus on England/Wales, the Netherlands, France, Germany, and Spain, the book reveals that there are enormous differences in both drafting and interpretation of serious traffic offenses. Additionally, it elaborates on the role of culpability and harm in sentencing, traffic-psychological insights relevant to accident causation, and the concept of conditional intent in relation to extremely dangerous traffic behavior.
