With contributions from experts in the field of sociology of law, this book provides an overview of current perspectives on socio-legal studies. It focuses particularly on the relationship between law and society described in recent social systems theory as ‘structural coupling’. The first part of the book presents a reconstruction of theoretical tendencies in the field of socio-legal studies, characterised by the emergence of a transnational model of legal systems no longer connected to territorial borders and culturally specific aspects of single legal orders. In the following parts of the book, the contributions analyse some concrete cases of interrelation between law and society from an empirical and theoretical perspective.

Oaths play an essential part in the political and religious history of the West as a 'sacrament of power'. Yet despite numerous studies by linguists, anthropologists and historians of law and of religion, there exists no complete analysis of the oath which seeks to explain the strategic function that this phenomenon has performed at the intersection of law, religion and politics. The oath seems to define man himself as a political animal, but what is an oath and from where does it originate? Taking this question as its point of departure, Giorgio Agamben's book develops a pathbreaking 'archaeology' of the oath. Via a firsthand survey of Greek and Roman sources which shed light on the nexus of the oath with archaic legislation, acts of condemnation and the names of gods and blasphemy, Agamben recasts the birth of the oath as a decisive event of anthropogenesis, the process by which mankind became humanity. If the oath has historically constituted itself as a 'sacrament of power', it has functioned at one and the same time as a 'sacrament of language' - a sacrament in which man, discovering that he can speak, chooses to bind himself to his language and to use it to put life and destiny at stake.

There was an old woman in China who had supported a monk for over twenty years. She had built a little hut for him and fed him while he was meditating. Finally she wondered just what progress he had made in all this time. To find out, she obtained the help of a girl rich in desire. “Go and embrace him,” she told her, “and then ask him suddenly: ‘What now?’” The girl called upon the monk and without much ado caressed him, asking him what he was going to do about it. “An old tree grows on a cold rock in winter,” replied the monk somewhat poetically. “Nowhere is there any warmth.” The girl returned and related what he had said. “To think I fed that fellow for twenty years!” exclaimed the old woman in anger. “He showed no consideration for your need, no disposition to explain your condition. He need not have responded to passion, but at least he could have evidenced some compassion.” She at once went to the hut of the monk and burned it down. Born Liquid is the last work by the great sociologist and social theorist Zygmunt Bauman, whose brilliant analyses of liquid modernity changed the way we think about our world today. At the time of his death, Bauman was working on this short book, a conversation with the Italian journalist Thomas Leoncini, exactly sixty years his junior. In these exchanges with Leoncini, Bauman considers, for the first time, the world of those born after the early 1980s, the individuals who were ‘born liquid’ and feel at home in a society of constant flux. As always, taking his cue from contemporary issues and debates, Bauman examines this world by discussing what are often regarded as its most ephemeral features. The transformation of the body – tattoos, cosmetic surgery, hipsters – aggression, bullying, the Internet, online dating, gender transitions and changing sexual preferences are all analysed with characteristic brilliance in this concise and topical book, which will be of particular interest to young people, natives of the liquid modern world, as well as to Bauman’s many readers of all generations.

"Schopenhauer's analyses of causation and related concepts . . . rival and probably surpass in their depth and brilliance the more celebrated discussions of David Hume. Where Hume grossly oversimplified these problems and left them riddled with paradoxes, Schopenhauer disentangled them and shed light on what had seemed hopelessly dark." --Richard Taylor, University of Rochester
