Cet ouvrage explore les valeurs tribales et leur dimension identitaire dont la prise en compte est indispensable pour trouver des solutions au conflit du Sahara espagnol, issu de la décolonisation. L’étude souligne qu’au lieu de revenir à la base, l’ONU est partie d’en haut, ignorant les droits des Sahraouis absents des listes espagnoles de 1974, seules considérées comme le référentiel identitaire. L’identification des votants au référendum d’autodétermination des populations du Sahara occidental est en effet la condition du règlement de ce conflit, nécessitant la définition des tribus du Wad Nun et de la Sagiya al-Hamra. Pour distinguer ces deux régions, situées au coeur de l’espace ouest-saharien, on mobilise généralement la question des modes de gestion de l’espace, qui implique de déterminer la place du droit tribal et celle de la propriété. Or, le droit international réduit l’ordre tribal au seul référentiel d’établissement des listes espagnoles pour examiner les positions respectives du Maroc et du Front Polisario, retenant les positions de ce dernier comme l’unique représentant des Sahraouis. Une étude fine des régions du Wad Nun et de la Sagiya al-Hamra, engagée dès 1982, met en évidence une permanence du politique et de l’idée de souveraineté dans les sociétés tribales. Elle amène à penser le pouvoir de la tribu et le pouvoir makhzenien sur la longue durée historique. Le mythe jihadien mêle le religieux à cette histoire et l’inscrit dans les dynamiques et mobilisations tribales. La territorialité dépend toutefois des choix stratégiques des tribus. Lorsque par exemple dans les années 1950, se développe une mobilisation supra tribale dans la Sagiya al-Hamra, elle s’imposera en contradiction avec les objectifs de l’Armée de Libération du Sud-Marocain et révélera qu’au Sahara se conjuguent trois formes de souveraineté : celle des tribus sur leur territoire, celle du jihad et celle du pouvoir sultanien théocratique (makhzen). La souveraineté sur le territoire saharien associait depuis longtemps les tribus du Wad Nun, colonisées par la France, et leur extension migratoire dans la Sagiya al-Hamra, colonisée, elle, par l’Espagne. Inspiré des milieux politiques et académiques, le projet indépendantiste porté par le Front Polisario maintiendra la séparation de ces deux régions, jouant dès lors le rôle de déclencheur dans le développement politique du conflit. La résolution de ce dernier passe donc par une approche qui fasse toute sa place à la complexité historique. Mustapha Naïmi est professeur de l’Université Mohamed V-Souissi à Rabat, où il dirige l’Équipe des études sahariennes pluridisciplinaires à l’Institut universitaire de la recherche scientifique.
