This collection discusses the concept of fraternity and examines the issue of its role in law. Since the end of World War II, fraternity has been cited in several national constitutional charters, in addition to the United Nations Universal Declaration of Human Rights. But is there space for fraternity in law? The contributions to this book form an ideal “bridge” between the past and present to trace the different pathways taken to address the meaning of fraternity, and to identify its possible legal relevance. The book lays out paths that have placed fraternity in varied and challenging legal contexts in an age of globalization and conflict, where the multiplicity of national and supranational sources of law seems to show its inadequacy to govern complexity, and coexistence between diversities that appear irreconcilable. The purpose is not to recover fraternity as a forgotten principle, but to reimagine it today to address the aim and force of law within a plurality of cultures. The analysis considers a possible universal dimension that models unity within diversity, and aspires to serve as a prologue to a transition from research to dialogue between different legal systems and traditions. The book will be of interest to academics and researchers working in the areas of Comparative Law, Legal History and Legal Philosophy.

Un certo tipo di riflessione bioetica mette spesso sotto accusa la tecnologia come segno di arroganza e insofferenza nei confronti dei limiti insiti nella condizione umana. In altri termini, si tratta dello schema interpretativo per cui, morto Dio, si affaccia sulla scena il Superuomo con il relativo affermarsi di una volontà di potenza inarrestabile. Il fantasma di Nietzsche, con quanto di morboso e terribile è associato al suo pensiero, va a braccetto col mito di Prometeo, ed entrambi sono evocati per far risaltare, per contrasto, un mondo fatto di certezze metafisiche e di ordine naturale in cui ogni cosa trova una sua collocazione e al quale, dimenticando quanto le metafisiche cadano spesso in contraddizioni insanabili tra loro, l’etica chiede solo di adeguarsi fiduciosamente. Da qualche tempo la cronaca, anche prima dell’evento pandemico, propone notizie spesso drammatiche di problemi correlati allo sviluppo della biomedicina. La cosa di per sé può essere un bene perché così si esalta il significato della bioetica come movimento di opinione e di emancipazione individuale. Un male perché spesso la rappresentazione giornalistica tende a semplificare e, a volte, anche a banalizzare questioni e controversie serie. Negli articoli qui raccolti, Prodomo naviga cercando di evitare sia la Scilla della pedanteria che la Cariddi della sciatteria. Ai lettori il giudizio circa la riuscita di questo intento.

Everyday Feminist Research Praxis: Doing Gender in The Netherlands offers a selection of previously unpublished work presented during the 2011, 2012 and 2013 Netherlands Research School of Gender Studies (NOG) conferences. Reflecting the wide spectrum of interdisciplinary gender studies, this volume is organised into four sections along four conceptual knots. These thematic entry-points are space/time, affectivity, public/private, and technological mediation. The central emphasis of this volume is twofold: first, the everyday is approached as a concretely grounded site of micro-political power struggles. Second, the contributors make explicit connections between theory and their everyday feminist research practices. As a whole, the interventions – ranging from fashion modelling, child-birthing discourses and digital documentaries – show how feminist research praxis remains crucial in critically disentangling naturalized routines of daily life, which in turn enables the scrutiny of, for example, the arbitrariness of entrenched power relations and contradictory, personal and collective, everyday trajectories. Everyday Feminist Research Praxis, thus, energises possibilities for new forms of recognition, representation and redistribution of power.

L'interrogativo che muove l'indagine qui proposta, condotta a molte voci ma espressiva di un disegno unitario, riguarda la 'pensabilità della libertà nella condizione postmoderna dell'esperienza'. Dopo una prima parte esplorativa delle coordinate culturali e antropologiche in cui si collocano prassi e teoria della libertà nell'era della tecnica, la seconda parte inaugura un percorso alla 'ricerca di un profilo teorico persuasivo della libertà umana', colta nella sua struttura antropologica pluridimensionale, nel suo 'paradosso' ontologico-metafisico, nell'enigma tragico della sua defettibilità colpevole e nella sua vocazione teologica. La terza parte torna alle questioni dell'oggi, con un approccio critico e propositivo ad alcuni 'aspetti problematici rispetto all'idea o alla prassi della libertà'. Si tratta di saperi che toccano in modo incisivo la possibilità della libertà, e insieme l'identità soggettiva, come avviene nella sociobiologia, nelle scienze cognitive, nella psicoanalisi. Si tratta poi di condizioni e problemi sociali in cui è in gioco la praticabilità della libertà nel suo esercizio pubblico, come avviene nella nuova organizzazione del lavoro, nelle tecnologie della comunicazione sociale, nelle attuali condizioni di pluralismo culturale e religioso, nel problema dell'educazione. Il risultato dell'indagine è multiplo. Emerge, in primo luogo, una rinnovata consapevolezza della 'centralità della questione tecnologica', risultando la tecnologia al tempo stesso occasione e insidia per la libertà. In questa condizione culturale epocale è di estrema importanza riscattare la libertà da una concezione astratta, per guadagnarne la pienezza antropologica quale 'organismo polisenso' di scelta, finalità e relazione, e insieme l'unità trascendentale come autodeterminazione.
