Sono raccolti gli scritti che alcuni amici, con affetto e gratitudine, hanno dedicato a Maurizio Converso. Dal 1976 al 2013 è stato coordinatore della rivista il Foro italiano, alla quale ha iniziato a collaborare nel 1972. Ha tenuto incarichi di insegnamento presso Università italiane e istituzioni pubbliche e private. Senza ricoprire cariche istituzionali e senza assumere alcun ruolo ufficiale, Maurizio Converso è stato ed è, nella cultura italiana, un riferimento fondamentale per la documentazione giuridica e non solo. Nella consapevolezza della prevalenza dei rapporti umani, con profonda gratitudine e con affetto, gli è dedicato questo libro, la realizzazione del quale è dovuta alla paziente opera di Domenico Dalfino, al quale, unitamente ad Angelo Danilo De Santis, va il sentito ringraziamento degli autori.

The preliminary reference procedure under Article 267 TFEU is the keystone of the EU judicial system and its legal order. Based on a dialogue between the Court of Justice and national courts, it is strictly linked to the protection of the rights that individuals derive from EU law. This book focuses on this procedure from the perspective of the right to effective judicial protection, in light of Article 19(1), second subparagraph, TEU and Article 47 of the Charter of Fundamental Rights of the EU. It explores the level of protection that is ensured to individuals in order to access to the Court of Justice through preliminary references on the validity of EU acts and on the interpretation of EU law. The book offers a threefold perspective on preliminary references, through an analysis of the case law of the Court of Justice itself, of the European Court of Human Rights in relation to Article 6(1) ECHR, and of the constitutional courts of Austria, Croatia, Czech Republic, Germany, Slovakia, Slovenia, and Spain, where the national courts’ refusals to refer can lead to the violation of national constitutional rights. It further investigates the obligations for Member States and national courts in the framework of the preliminary reference procedure and how the right to effective judicial protection affects them. The examination outlines the implications that could flow from the recognition of a right for individuals to have a question referred to the ECJ, as part of the right to effective judicial protection under EU law, in particular its nature and its enforcement. Building upon the existing system of sanctions for the violations of the obligation to submit a preliminary question, the book advances some proposals to rethink the current system of remedies.

This book investigates judicial deference to the administration in judicial review, a concept and legal practice that can be found to a greater or lesser degree in every constitutional system. In each system, deference functions differently, because the positioning of the judiciary with regard to the separation of powers, the role of the courts as a mechanism of checks and balances, and the scope of judicial review differ. In addition, the way deference works within the constitutional system itself is complex, multi-faceted and often covert. Although judicial deference to the administration is a topical theme in comparative administrative law, a general examination of national systems is still lacking. En el conjunto del ordenamiento aparecen con frecuencia, al lado de las normas que expresan principios generales y de las más habituales reglas ordinarias de contenido específico preciso, normas que acogen conceptos elásticos o formulaciones abiertas, las cuales, si en un cierto momento fueron vistas, pese a la antigüedad y el prestigio de algunas de ellas, con no pocas reticencias, se consideran hoy constitutivas de una técnica insuprimible de la conformación del derecho escrito. Entre tales normas se encuentran las que contienen cláusulas generales en sentido estricto (como la buena fe, la moral o el orden público), conceptos jurídicos indeterminados (como, entre tantísimos otros, el interés del menor, la situación de desamparo, el cabal juicio, el extraordinario valor o la remuneración suficiente), modelos de apreciación referencial (como los de buen padre de familia, administrador leal o buen labrador) y parámetros de ponderación (como los de proporcionalidad, razonabilidad y, en una de las dos acepciones legislativas de la misma, equidad).Con los límites de una cierta contenida extensión, esta monografía se propone examinar, además de la configuración diferenciada de tales enunciados legales, su significación disciplinar y la aplicación de los mismos en la actividad judicial.

A collection of essays that span many regions and cultures, by an award-winning historian Sanjay Subrahmanyam is becoming well known for the same sort of reasons that attach to Fernand Braudel and Carlo Ginzburg, as the proponent of a new kind of history - in his case, not longue durée or micro-history, but 'connected history': connected cross-culturally, and spanning regions, subjects and archives that are conventionally treated alone.
