The increasingly competitive market environment, in which port clusters operate today, imposes new requirements on port strategy analysis. Many port authorities and port operators now realize that a static approach to cost leadership, a sole focus on inherited factor advantages and a simplistic reliance on new infrastructure to attract or retain clients, are no longer sufficient to guarantee a port's competitive success. They need to offer greater value added to port users, as well as to society. Hence, this new market environment forces ports to reconsider their present strategic position and to reflect on the strategic options for the future. The book builds upon an in-depth survey of economic actors in the Antwerp seaport cluster, with a specific focus on the container and conventional cargo clusters. It attempts to answer the question why these particular port clusters arc more competitive than similar clusters in other ports. In order to answer this question, the study develops and extends a number of formal tools of strategy analysis that should be useful to both port authorities and port operators.

This is the first book to offer a comprehensive overview of modern seaports from a legal perspective. Further, it provides a basic toolkit for establishing a legal doctrine of seaports, the instruments of said toolkit being the very few legal norms specifically targeting seaports, which are examined as such rather than through the lens of other, more established disciplines, such as the law of the sea or transportation law. It is a first, necessary step toward giving seaports the status they rightfully deserve in legal studies. Despite centuries of international law studies and decades of EU law evolution, seaports have remained stuck in limbo. From a law of the sea perspective, seaports belong to the land, an approach that is often clearly reflected in national maritime legislation. The other branches of international law do not focus on seaports, since they are considered to belong to the sea. The port communities, for their part, have availed themselves of the “port specificity” concept. In recent decades, containerization has transformed ports into key hubs of the globalized economy, but also into vital checkpoints of the War on Terror, due to the security risks posed by the millions of sealed containers circulating worldwide. Moreover, tragic maritime incidents have shown that seaports are the only reliable sentinels of the seas, being the only places where the systematic inspection of ships is feasible. This has led to the adoption of specific international and EU rules. Those rules, however, remain fragmented, highly specialized and technical; as such, they are unsuitable for creating an organic legal seaport regime: this objective can only be achieved with a significant contribution from legal doctrine.

The phenomenon of international seaport administration is the subject of this book. As a Ph.D.-student at the Delft University of Technology (period 1993 - 1997) I had the opportunity to develop and exercise my hobby on a full time base. The result was a Ph.D.-dissertation which was defended in December 1997. Unfortunately, these research results were published in Dutch while the majority of the interviewees and employees in the world of international seaport administration are English speaking people. Both for the reason of high international relevance of the results I felt the necessity to get this Ph.D.-research translated and published in English. With the excellent help of my promotor Prof.dr. W.G.M. Salet I found Prof.dr. H. van der Wusten prepared to cover this study on international seaport administration in the Kluwer GeoJournal Library series. I thank Mr. Van der Wusten for giving me this opportunity. But also due to the outstanding help of my current employer 'Zeeland Seaports Authority' the funding for the translation became very quickly possible. Chapter 3 is concerned with the growth of developing countries ., which depends very much on having adequate physical infrastructure to support economic development. As a strategic response, many physical infrastructure investments like seaports are being privatised and highly purpose built. Merits of the viable, long term, seaport investment, and of structuring a defensible risk management strategy are essential to deal with uncertainties. Singapore’s Jurong Port is the case study. Chapter 4 is concerned with the global outreach of the small island state of Singapore’s seaport operation, owing to its chronic and limited land and small population size. To overcome limiting growth prospects, it is essential to grow and sustain the global outreach of the Port of Singapore. Last but not least, Chapter 5 recognizes that for public physical infrastructure developments like Singapore’s global Changi Airport, public funding is also a form of investment that entails uncertainties, which need to be rigorously evaluated with financial modelling on the risks and returns. Even more so for crucial seaport expansion and for developing a larger strategic objective for the long-term, well-being of the nation. Changi Airport is a key pillar of strength to support the growth of Singapore’s trade-oriented market economy.
