Die Datenschutz-Grundverordnung hat das Prinzip der rechtlichen Selbstverantwortung gesetzlich in Art. 5 i.V.m. Art. 24 DSGVO verankert und den Normadressaten mit den datenschutzrechtlichen Instrumenten der Verhaltensregeln nach Art. 40 und 41 DSGVO, der Zertifi zierung nach Art. 42 und 43 DSGVO und der Datenschutz-Folgenabschätzung nach Art. 35 und 36 DSGVO die Möglichkeit gegeben, ihrer übertragenen Selbstverantwortung nachzukommen. Diese datenschutzrechtlichen Instrumente können die Umsetzung der Datenschutz-Grundverordnung in der Praxis erleichtern und verbessern. Zugleich besteht jedoch die Gefahr, dass diese Instrumente missbraucht werden könnten und es in der Folge zu einer Beeinträchtigung von Grundrechten betroffener Personen kommt.
