While Sentencing in Tasmania's focus is on Tasmania, it is relevant to all Australian jurisdictions because it contains an exposition of the common law principles in relation to sentencing, including recent High Court decisions such as Olbrich (fact finding and sentencing), Ryan (sexual offenders and good character), Dinsdale (suspended sentences), Pearce (double punishment), and Postiglione (totality and parity). The discussion of specific crimes and offences includes a section on social security fraud and provies sentencing ranges for the most common offences based on national data for sentences imposed in 2000. The book will be particularly useful in those jurisdictions that do not have a comprehensive and up-to-date treatise on the law of sentencing.

The Tasmanian Attorney-General and Minister for Justice requested that the Sentencing Advisory Council provide a report on the implementation of minimum mandatory sentencing for those who commit serious sexual offences against children, following on from the Government's pre-election commitment on the issue. In particular, the Council was asked to investigate Tasmania?s current legislation for sentencing sex offenders, the legislative means required to implement mandatory sentencing for serious sex offences committed against children, and advice as to which offences should be captured within the scope of the mandatory sentencing provisions and what those mandatory minimum sentences should be. Following a public research paper and consultations, this final report presents the Council's advice and a model on how mandatory sentencing could be implemented. Note, the Council has previously indicated that it does not recommend the introduction of mandatory sentencing in Tasmania, and its objections are also laid out.

This book provides a detailed description of how professional groups collaborate in reaching sentencing decisions in children's courts. Based on observation of hearings in the three Australian states of Tasmania, Victoria and New South Wales, it describes the practical considerations in sentencing minor, and repeat offenders, and the mitigating factors that influence magistrates. These include economic circumstances, family problems and psychological difficulties, but also youthfulness itself. This book has a discursive quality... It is a very user-friendly book and will be particularly accessible by students at all levels, both those with and without any socio-legal or criminology background.
