Il crimen plagii dall’età dioclezianea al tardo Impero è diventato, rispetto al crimine in origine previsto dalla lex Fabia, un contenitore di fattispecie diverse che coesistono tra loro: in quest’epoca, infatti, il crimine individua sovente più azioni criminose: il sequestro di persona, la riduzione in schiavitù ed il traffico di esseri umani, siano essi liberi o schiavi, adulti o bambini. Spiccano in questi secoli, in particolare, due costituzioni: una prima di Massimiano, che individua, verosimilmente, un «reato continuato» al fine di applicare la pena più grave nei confronti dei colpevoli di plagio ogni qualvolta si riscontri un concorso di persone nel reato; un’altra singolare costituzione è quella di Costantino, la quale prevede pene severe in caso di aggravanti e riguarda un crimen plagii ancora più riprovevole, in quanto le vittime sono i minori. L’analisi delle fonti giuridiche mette in evidenza le trasformazioni di questo crimine, la gravità che questo rappresentava per l’Impero, il conseguente inasprimento delle pene, ma, soprattutto, come in tempi diversi erano andate appunto ad enuclearsi fattispecie differenti intorno a quelle previste in origine dalla lex Fabia, mentre d’altra parte avevano continuato a coesistere, nonostante le diverse azioni criminose, le diverse procedure nonché le diverse pene comminate.

«Ordine» e «ordinamento». Idee e categorie giuridiche nel mondo romano prende lo spunto da un’osservazione esegetica, segnatamente da un’apparente, inspiegabile presenza del termine ‘ordo’ in alcune interpretazioni visigotiche, e la sua rispettiva assenza nei testi romani di riferimento. Al contempo si è notato che in tali passi ‘ordo’ sostituisce il concetto di ‘regula’ . Il dato è stato inserito in un contesto più ampio che, procedendo a ritroso, esamina le fonti giuridiche contenenti sia ‘regula’ sia ‘ordo’ . Si è così notato che il lemma ‘regula’ , di derivazione aristotelica, individua più concetti che si evolvono nel tempo, rispecchiando i diversi assetti giuridici. Anche‘ordo’ è impiegato dai ‘prudentes’, ma in senso di progressione. Sarà Augusto che, in virtù di una spinta sistematica, impiegherà ‘ordo’ anche in senso di sistema. Non di meno, non si delinea una immediata evoluzione per tale genus, come se il concetto di sistema in sé concluso fosse rifiutato dalla giurisprudenza classica, che si poneva nella prospettiva del metodo, ossia ‘regula iuris’, più che della categoria, ‘ordo iuris’. Diversamente, i giuristi occidentali del V-VI secolo si dedicano anche alla stesura di normazioni, come la Lex Romana Visigothorum, o Ostrogothorum, che vogliono individuare un sistema in sé concluso, una sorta di ordinamento. Proprio il concetto di ‘ordo’ si inserisce in questa dinamica, quale frutto della loro speculazione teorica e ideologica, che risente della filosofia neoplatonica. Pertanto, se la ‘regula’ risponde a un’esigenza di sintesi di ispirazione aristotelica, l’‘ordo’, che la sostituisce, avrebbe risentito di una corrente di pensiero neoplatonico tendente all’enucleazione di un sistema, formalmente e tendenzialmente chiuso, che troverà seguito nella normazione occidentale post-giustinianea. Lucia Di Cintio in precedenza si è occupata di obbligazioni naturali, con una monografia dal titolo Natura debere. Sull’elaborazione giurisprudenziale romana in tema di obbligazione naturale, Soveria-Mannelli, 2009. In seguito, si è dedicata alla ricostruzione della cosiddetta ‘Interpretatio’ visigotica, pubblicando due libri, L’Interpretatio Visigothorum al Codex Theodosianus I. This book shows how Darwinian biology supports an Aristotelian view of ethics as rooted in human nature. Defending a conception of "Darwinian natural right" based on the claim that the good is the desirable, the author argues that there are at least twenty natural desires that are universal to all human societies because they are based in human biology. The satisfaction of these natural desires constitutes a universal standard for judging social practice as either fulfilling or frustrating human nature, although prudence is required in judging what is best for particular circumstances. The author studies the familial bonding of parents and children and the conjugal bonding of men and women as illustrating social behavior that conforms to Darwinian natural right. He also studies slavery and psychopathy as illustrating social behavior that contradicts Darwinian natural right. He argues as well that the natural moral sense does not require religious belief, although such belief can sometimes reinforce the dictates of nature.
