International lawyers have long recognised the importance of interpretation to their academic discipline and professional practice. As new insights on interpretation abound in other fields, international law and international lawyers have largely remained wedded to a rule-based approach, focusing almost exclusively on the Vienna Convention on the Law of Treaties. Such an approach neglects interpretation as a distinct and broader field of theoretical inquiry. Interpretation in International Law brings international legal scholars together to engage in sustained reflection on the theme of interpretation. The book is creatively structured around the metaphor of the game, which captures and illuminates the constituent elements of an act of interpretation. The object of the game of interpretation is to persuade the audience that one's interpretation of the law is correct. The rules of play are known and complied with by the players, even though much is left to their skills and strategies. There is also a meta-discourse about the game of interpretation - 'playing the game of game-playing' - which involves consideration of the nature of the game, its underlying stakes, and who gets to decide by what rules one should play. Through a series of diverse contributions, Interpretation in International Law reveals interpretation as an inescapable feature of all areas of international law. It will be of interest and utility to all international lawyers whose work touches upon theoretical or practical aspects of interpretation.

Treaty Interpretation written by Richard K. Gardiner and has been published by Oxford University Press, USA this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015 with Law categories.

The rules of treaty interpretation codified in the 'Vienna Convention on the Law of Treaties' now apply to virtually all treaties, in an international context as well as within national legal systems, where treaties have an impact on a large and growing range of matters. The rules of treaty interpretation differ somewhat from typical rules for interpreting legal instruments and legislation within national legal systems. Lawyers, administrators, diplomats, and officials at international organisations are increasingly likely to encounter issues of treaty interpretation which require not only knowledge of the relevant rules of interpretation, but also how these rules have been, and are to be, applied in practice. Since the codified rules of treaty interpretation came into decree, there is a considerable body of case-law on their application. This case-law, combined with the history and analysis of the rules of treaty interpretation, provides a basis for understanding this most important task in the application of treaties internationally and within national systems of law. Any lawyer who ever has to consider international matters, and increasingly any lawyer whose work involves domestic legislation with any international connection, is at risk nowadays of encountering a treaty provision which requires interpretation, whether the treaty provision is explicitly in issue or is the source of the relevant domestic legislation. This fully updated new edition features case law from a broader range of jurisdictions, and an account of the work of the International Law Commission in its relation to interpretative declarations. This book provides a guide to interpreting treaties properly in accordance with the modern rules.

Imagining Europe Memory Visions And Counter Narratives written by Lars Klein and has been published by Göttingen University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015 with categories.

In the course of the so-called ‘economic and financial crisis’ from 2008 onwards, there has been a fierce debate about the role and purpose of the European Union. It was led in politics and the media just as in academia. The economic usefulness of the Euro has been discussed, and the political implications of a fostered European unification. Most often, the state of Europeanization has been presented as being without alternatives: no Europe without Greece; no Euro without Greece; no way back to the nation state in its old form. As a result, the debate on Europe was largely narrowed down to the very questions of the immediate crisis, namely economics and fi nance. Only a few voices held that the crisis in fact was one of politics, not of economics. And only late did politicians mention again that Europe is more than the EU. Alternative views of Europe, however, were scarce and often presented full of consequences. It thus came without much surprise that the lacking imaginative power of politicians as well as intellectuals was criticized. The idea for this volume sprang from that situation. The editors invited scholars from various disciplines to present them with ways of imagining Europe that go beyond the rather limited view of EU institutions. How was, how is Europe imagined? Which memories are evoked, which visions explicated? Which counter-narratives to prominent discourses are there?

This book explores the historial role of the Balkan Wars. In Eastern Europe, the two Balkan Wars of 1912/13 had greater importance than the First World War for the construction of nations and states. This volume shows how these “short” wars profoundly changed the sociopolitical situation in the Balkans, with consequences that are still felt today. More than one hundred years later, the successors of the belligerent states in Southeastern Europe memorialize the wars as heroic highlights of their respective pasts. Furthermore, the metaphor that the Balkans were Europe’s “powder keg”, perpetuated at the beginning of the twentieth century in the face of these wars, was reactivated in both the West and the East up through the Yugoslav wars of the 1990s. The authors entangle the hitherto exclusive national master narratives and analyse them cogently and trenchantly for an international readership. They make an indispensable contribution to the proper integration of the Balkan Wars into the European historical memory of twentieth-century warfare.

For much of Europe, the interwar period was one of cultural expansion and diversion and increased visibility for lesbians. While historical research on Germany during the period immediately after the First World War has been extensively studied by historians through the lens of gender and sexuality—with an implicit emphasis on the “masculine” dimension of queer female sexuality—the Dutch context has been virtually ignored. Through careful and sensitive studies of medico‐social discourses, media representations, and literary depictions of queer femininity, Different from the Others recovers the submerged history of queer feminine women in both Germany and the Netherlands. Cyd Sturgess provides a theoretical analysis that makes key empirical contributions to the history of Dutch gays and lesbians while reframing our collective understanding of queer femininity more broadly.
