Excerpt from Trattato Teorico-Pratico Sulle Servitù Prediali, Vol. 3: Servitù nell'Utilizzazione del Suolo Proprio e per Utilizzazione dell'Altrui La fisionomia di queste servitù è ben diversa da quella delle servitù considerate nel volume precedente. In quello si trattava di servitù delle acque e per veicolo aereo, ossia per le quali il veicolo atmosferico e indispensabile e si pre senta come coefficiente dello stato di fatto che alla servitù corrisponde. Or l'aria e l'acqua essendo beni comuni e l'aria non suscettibile di appropriazione come la terra, mentre l'acqua è appropriabile sotto certe condizioni e con certi limiti e in forma ben diversa dal suolo, se ne deduce abba stanza chiaramente cbe le servitù, le quali si aggirano at torno alla proprietà del suolo e con questa proprietà sono connesse, debbono dar vita ad una classificazione fondata su di uno speciale e distinto ordine di criteri meritevole di particolare considerazione e di una trattazione distinta con metodi propri. Qui anche le traccie sono, per cosi dire, più immanenti e visibili nell'esercizio della servitù, allorchè si tratti di servitù continue; e le stesse servitù discontinue sono quasi per contenuto meno equivoche, o, come suol dirsi, più parlanti e meno discoste dall'equivoco di un uso emulativo o semplicemente molesto delle cose proprie, per un canto, e dalla similitudine ad uno stato di comunione per l'altro. Generalmente, si tratta d'invasione sul suolo altrui, ossia di un attentato (sia pure per causa legittima e giustificato dalla legge) contro la proprietà e in terreno altrui, che non può in guisa alcuna mascherarsi o dissimularsi.
