In July 2007, the School of Law at the University of Warwick hosted an international conference on 'Shakespeare and the Law'. This was a truly interdisciplinary event, which included contributions from eminent speakers in the fields of English, history, theatre and law. The intention was to provide a congenial forum for the exploration, dissemination and discussion of Shakespeare's evident fascination with and knowledge of law, and its manifestation in his works. Conceptualizing the curse as the representation of a foundational, mythical violence that is embedded within juridical discourse, Shakespeare’s Curse pursues a reading of Richard III, King John, and King Lear in order to analyse the persistence of imprecations in the discourses of modernity. Shakespeare wrote during a period that was transformative in the development of juridical thinking. However, taking up the relationship between theatre, theology and law, Bjoern Quiring argues that the curse was not eliminated from legal discourses during this modernization of jurisprudence; rather, it persisted and to this day continues to haunt numerous speech acts. Drawing on the work of Derrida, Lacan, Walter Benjamin and Giorgio Agamben, among others, Quiring analyses the performativity of the curse, and tracks its power through the juristic themes that are pursued within Shakespeare’s plays – such as sovereignty, legitimacy, succession, obligation, exception, and natural law. This volume presents a close reading of instances of Shakespearean quotations, allusions, imagery and rhetoric found in Karl Marx’s collected works and letters, which provides evidence that Shakespeare’s writings exerted a formative influence on Marx and the development of his work. Through a methodology of intertextual and interlingual close-reading, this study provides evidence of the extent to which Shakespeare influenced Marx and to which Marxism has Shakespearean roots. As a child, Marx was home-schooled in Ludwig von Westphalen’s little academy, as it were, which was Shakespeare- and literary-focused. The group included von Westphalen’s daughter, who later became Marx’s wife, Jenny. The influence of Shakespeare in Marx’s writings shows up as early as his school essays and love letters. He modelled his early journalism partly on ideas and rhetoric found in Shakespeare’s plays. Each turn in the development of Marx’s thought—from Romantic to Left Hegelian and then to Communist—is achieved in part through his use of literature, especially Shakespeare. Marx’s mature texts on history, politics and economics—including the famous first volume of Das Kapital—are laden with Shakespearean allusions and quotations. Marx's engagement with Shakespeare resulted in the development of a framework of characters and imagery he used to stand for and anchor the different concepts in his political critique. Marx’s prose style uses a conceit in which politics are depicted as performative. Later, the Marx family—Marx, Jenny and their children—was central in the late-19th-century revival of Shakespeare on the London stage, and in the growth of academic Shakespeare scholarship. Through providing evidence for a formative role of Shakespeare in the development of Marxism, the present study suggests a formative role for literature in the history of ideas.

Shakespearean Genealogies of Power proposes a new view on Shakespeare’s involvement with the legal sphere: as a visible space between the spheres of politics and law and well able to negotiate legal and political, even constitutional concerns, Shakespeare’s theatre opened up a new perspective on normativity. His plays reflect, even create, "history" in a new sense on the premises of the older conceptions of historical and legal exemplarity: examples, cases, and instances are to be reflected rather than treated as straightforwardly didactic or salvific. Thus, what comes to be recognized, reflected and acknowledged has a disowning, alienating effect, whose enduring aftermath rather than its theatrical immediacy counts and remains effective. In Shakespeare, the law gets hold of its normativity as the problematic efficacy of unsolved – or rarely ever completely solved – problems: on the stage of the theatre, the law has to cope with a mortgage of history rather than with its own success story. The exemplary interplay of critical cultural and legal theory in the twentieth-century – between Carl Schmitt and Hans Kelsen, Walter Benjamin and Ernst Kantorowicz, Hans Blumenberg and Giorgio Agamben, Robert Cover and Niklas Luhmann – found in Shakespeare’s plays its speculative instruments.
