The vice president and former San Francisco district attorney presents her vision for smart criminal justice and public safety. Before she became the vice president of the United States, Kamala Harris was committed to fighting crime as a prosecutor in San Francisco’s Hall of Justice. Originally published in 2009, Smart on Crime shares her insight and offers a new approach designed to end the cycle of repeat offenders. Harris shatters the old distinctions rooted in false choices and myths. She presents practical solutions for making the criminal justice system truly—not just rhetorically—tough. Smart on Crime spells out the policy shifts required to increase public safety, reduce costs, and strengthen our communities.

Earlier this month, a coalition of criminal justice and human rights organizations including the Open Society Foundations released Smart on Crime: Recommendations for the Administration and Congress. One of the most comprehensive documents highlighting the challenges confronting federal criminal justice policy, the Smart on Crime report seeks to provide policymakers in the 112th Congress and the Obama Administration with recommendations for change. Over 40 organizations and individuals who are leading voices in federal criminal justice reform collaborated to produce the report, which identifies over 100 concrete policy recommendations across 16 broad issues areas. The issue areas include: *Combating unnecessary expansions of criminal law. *Advocating for improvements to investigatory and forensic science standards. *Ensuring that persons accused of crimes have an opportunity to receive a fair trial. *Helping persons who have served their sentences successfully enter their communities. *Protecting the rights and dignity of victims of crime. Recommendations range from helping to restore and empower victims to identifying ways to protect the rights of the accused. The Smart on Crime report is informed by five fundamental principles, which should be a part of all criminal justice system reforms: fairness, accuracy, effectiveness, evidence, and cost-effectiveness.

The most punitive era in American history reached its apex in the 1990s, but the trend has reversed in recent years. Smart on Crime: The Struggle to Build a Better American Penal System examines the factors causing this dramatic turnaround. It relates and echoes the increasing need and desire on the part of actors in the American government system to construct a penal system that is more rational and humane. Author Garrick L. Percival points out that the prison boom did not naturally emerge as a governmental response to increasing crime rates. Instead, political forces actively built and shaped the growth of a more aggressive and populated penal system. He is optimistic that the shifting political forces surrounding crime and punishment can now reform the system, explaining how current political actors can craft more constructive and just policies and programs. The book shows how rationality and humanitarianism lead to a penal system that imprisons fewer people, does less harm to the lives of individual offenders and those close to them, and is less expensive to maintain. The book presents empirical data to concretely demonstrate what is working and what is not in today’s penal system. It closely examines policies and practices in Texas, Ohio, and California as comparative illustrations on what progress has been made or needs to be made in penal systems across the United States. The book includes a comprehensive discussion of highlighted issues, and relates more than two dozen interviews with pivotal political actors who clarify why there is a major shift underway in the American penal system. Their insights reveal paths that can be taken to improve the current penal system.

The U.S. is the world´s biggest jailor and one of the most affluent murderous countries, and yet its citizens pay more taxes to sustain law and order than their European counterparts. Yet, the U.S. has the most data in the world on the use of incarceration and its failure. Its researchers have identified more projects able to prevent violence than the rest of the world put together. Its legislators have access to pioneering data banks on cost effective ways to use taxes to reduce crime. We are left wondering why we cannot implement measures that we know will work, reduce crime, and cost less for law and order. Smarter Crime Control shows how to use recent knowledge and best practices to reduce the extraordinarily high rates of murder, traffic fatalities, drug overdoses, and incarceration, while avoiding the high taxes paid by families for policing and prisons. Providing detailed examples, Irvin Waller offers specific actions our leaders at all levels can take to reduce violence and lower costs to taxpayers. He focuses on how to retool policing and improve corrections to reduce reoffending and crime, while limiting criminal courts. He also shows how programs and investments in various strategies can help those youth on the path to chronic offending avoid the path all together. Waller shows how to get smart on crime to shift the criminal justice paradigm from the failing, outdated, racially biased, and exorbitant complex today to an effective, modern, fair and lean system for safer communities that spares so many victims from the loss and pain of preventable violence. He makes a compelling case for reinvesting what is currently misspent on reacting to crime into smart ways to prevent crime. Ultimately, he demonstrates to readers the importance of reevaluating our current system and putting into place proven strategies for crime and violence prevention that will keep people out of jail and make our streets and communities safer for everyone.

After the 2008 elections, America's policymakers will take a fresh look at the criminal justice system, which so desperately needs their attention. To assist with that review, leaders and experts from all aspects of the criminal justice community spent months collaboratively identifying key issues and gathering policy advice into one comprehensive set of recommendations for the new administration and Congress. This catalogue is the fruit of those labors. More than 25 organizations and individuals participated in developing policy recommendations across 15 broad issue areas. They then vetted those recommendations with a broader group of experts, representing a diversity of philosophies and points of view, to assess the substantive and political viability of each recommendation. For each issue area, the document: 1) Identifies and summarizes problems; 2) Evaluates possible solutions and identifies potential areas of agreement; 3) Indicates which parts of government have jurisdiction; 4) Notes potential supporters of the identified solutions and discusses opposing arguments; 5) Identifies experts who can provide further analysis; 6) Indicates the authors of that particular section; and 7) Provides hyperlinks to other materials that explore the issues in greater depth. In addition, the first few sections of the catalogue provide a broad overview of the criminal justice system as it now exists; indicate objectives that must be afforded priority consideration; identify items for executive and legislative action; and list participating individuals and organizations.

The Future Of Crime And Punishment written by William R. Kelly and has been published by Rowman & Littlefield this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-07-14 with Political Science categories.

Today, we know that crime is often not just a matter of making bad decisions. Rather, there are a variety of factors that are implicated in much criminal offending, some fairly obvious like poverty, mental illness, and drug abuse and others less so, such as neurocognitive problems. Today, we have the tools for effective criminal behavioral change, but this cannot be an excuse for criminal offending. In The Future of Crime and Punishment, William R. Kelly identifies the need to educate the public on how these tools can be used to most effectively and cost efficiently reduce crime, recidivism, victimization and cost. The justice system of the future needs to be much more collaborative, utilizing the expertise of a variety of disciplines such as psychology, psychiatry, addiction, and neuroscience. Judges and prosecutors are lawyers, not clinicians, and as we transition the justice system to a focus on behavioral change, the decision making will need to reflect the input of clinical experts. The path forward is one characterized largely by change from traditional criminal prosecution and punishment to venues that balance accountability, compliance, and risk management with behavioral change interventions that address the primary underlying causes for recidivism. There are many moving parts to this effort and it is a complex proposition. It requires substantial changes to law, procedure, decision making, roles and responsibilities, expertise, and funding. Moreover, it requires a radical shift in how we think about crime and punishment. Our thinking needs to reflect a perspective that crime is harmful, but that much criminal behavior is changeable.
