This publication focuses on the challenges faced by civil society to remain sustainable in response to major changes in the global political, economic and social environment. Academics and practitioners from all over the world have contributed original articles, practical notes and viewpoints which critically examine the ways in which civil society organisations are affected by and are responding to political and financial dynamics. These include reductions in traditional external aid for civil society activities, but also the growth of new forms of funding through social enterprise, philanthropy, fundraising and contractual relationships with national government. The operating environment for civil society is a central theme, with authors exploring the legitimacy and credibility of different types of civil society organisation, as well as the effects of legislative and regulatory restrictions on their sustainability. El presente trabajo aborda de manera crítica la regulación del contrato de sociedad civil, recogida en los artículos 1665 y siguientes del Código Civil. A pesar de que es innegable la pérdida de importancia de la sociedad civil frente a la mercantil, el autor reclama su trascendental posición como categoría genérica a la que numerosos tipos especiales societarios le deben su existencia y las líneas básicas de su configuración jurídica. Asimismo advierte de su posible revitalización gracias a tipologías societarias como la de la sociedad profesional. Aunque el legislador ha pretendido regular de manera detallada este contrato, son muchos los interrogantes que se plantean en torno a su régimen jurídico y su aplicación práctica. La jurisprudencia, a su vez, no ha conseguido una unidad de criterio respecto de muchos de sus aspectos principales. De este modo, esta monografía pretende dar solución a cuestiones tan importantes como las relativas a la delimitación de la sociedad civil —en contraposición a la mercantil—, los elementos esenciales del contrato, sus efectos —diferenciando entre los que se producen internamente y aquellos que tienen lugar en las relaciones con terceros— o los supuestos de ineficacia. Todo ello, efectuando una rigurosa labor de análisis que pueda dar un sentido unitario a esta categoría contractual. Eduardo Serrano Gómez es Profesor Titular de Derecho Civil de la Universidad Complutense de Madrid y Vicedecano de Grado de su Facultad de Derecho. Es, además, Presidente de la Asociación para el Estudio y la Enseñanza del Derecho de Autor (ASEDA) y dirige el Anuario de Propiedad Intelectual que publica la editorial Reus. Ha desarrollado sus actividades docentes y/o de investigación tanto en universidades españolas (Universidad de Oviedo, Universidad de Santiago de Compostela, Universidad Jaume I de Castellón y Universidad Complutense de Madrid) como extranjeras (Universidad de Cardiff, Universidad de Leipzig, Universidad de Harvard, Universidad Panthéon-Sorbonne Paris 1, Universidad Parthenope de Nápoles, Universidad Autónoma Juárez de Tabasco, Universidad de La Habana, Universidad de La Plata, Universidad de Buenos Aires, Universidad Centroamericana de Nicaragua, Universidad Católica del Uruguay o Universidad Normal de Bei-jing). During the nearly 20 years of its existence, the Centro Mexicano para la Filantropía, A.C. (Cemefi, acronym in Spanish for the Mexican Center for Philanthropy) has promoted a varied agenda of research about civil society in Mexico. Cemefi has produced and published information on the characteristics of the social organizations that make up the Mexican nonprofit sector, as well as infor- tion about the type of legal, fiscal, and economic factors that promote or hinder organized citizen participation based on the principles of solidarity, social resp- sibility, and philanthropy. Once again, with the aim of bringing together information regarding the imp- tance of practices of solidarity in the country, Cemefi has decided to contribute to understanding, making known, and ultimately promoting volunteer action and acts of solidarity undertaken by citizens in this country. The end result of this effort is portrayed in this book, Mexican Solidarity: Citizen Participation and Volunteerism, edited and coordinated by Doctor Jacqueline Butcher. It is the product of a joint effort on the part of different people and insti- tions with a common goal: finding out about the characteristics of volunteerism and, in general, citizen participation in acts of solidarity in Mexico.
