A presente obra trata da necessidade de se repensar os mecanismos tradicionais de justiça de transição, em virtude de que estes têm, desde a década de 1990, negligenciado a chamada violência econômica, que inclui a corrupção. A corrupção é uma amarra na consecução dos direitos humanos, e seus efeitos atingem frontalmente os direitos sociais, o desenvolvimento e a democracia. A Convenção das Nações Unidas contra a Corrupção elevou a recuperação de ativos ao patamar de princípio fundamental no combate à corrupção, o que justifica o aumento exponencial dos esforços internacionais neste sentido. A lógica da impunidade permeia a corrupção em um cenário de criminalidade estatal e mais claramente em estados em transição do autoritarismo para a democracia. Por tal fato, não é mais possível negligenciar a corrupção nos mecanismos de justiça de transição, sob pena de tornar esta inconclusa. Nos mecanismos tradicionais de justiça de transição preponderam a sanção aos perpetradores em detrimento das questões humanas das vítimas; é necessário conferir à justiça de transição uma compreensão holística que contemple todas as violações passadas de direitos humanos, sob pena de ser instaurada uma seletividade indesejada da injustiça. Faz-se, neste contexto, necessária a construção da recuperação de ativos enquanto mecanismo de inflexão anticorrupção e de direitos humanos com vistas a alcançar a almejada paz positiva e o essencial estado de bem-estar social.
