Os astecas são as cidades que habitaram o Vale do México pouco antes da conquista espanhola do México em 1521. A obra discorre sobre a história da formação territorial brasileira e o território das Comunidades Tradicionais que, com direitos próprios e objetivando a produção de bens importantes para a sobrevivência coletiva e troca comerciais, se mantiveram por séculos ao largo das legislações territoriais impostas pelo poder estatal. As formas de uso tradicional e comunitário da terra e do território permanecem desconsideradas pelo discurso e prática do judiciário, sendo confrontadas com o direito de propriedade individual fundamentado meramente em prova registral. Essa tensão desafia o conceito jurídico de território, o confrontando frente à desigualdade, à fome e ao desrespeito com a diversidade das formas nativas de manutenção da vida garantidas na Constituição Federal. Constata-se relações conflituosas entre o direito estatal e o direito das práticas territoriais comunitárias, sugerindo uma proposta teórica na qual se supere a ideia de que o território das comunidades tradicionais é um espaço geográfico a-histórico sob o poder do direito de propriedade individual. É urgente considerar a grafia territorial das comunidades como identificação cultural e histórica, nos espaços de pertencimento a um lugar ou a uma forma de produção que as caracterize, para avaliar – nos pareceres sobre propriedade e posse dos territórios tradicionais – a tradição do seu uso, o respeito a seu manejo, o plantio dos alimentos e o respeito à terra como lugar de realização de culturas e tradições.
