Dabei wird zu aller erst auf die anthropologische Grundlage Somalias eingegangen. Themen dieses Bereich sind neben der Abstammungslehre auch die rechtlichen und gesellschaftlichen Grundlagen für das Zusammenleben der Somalis. Außerdem wird das Vertragssystem, Besetzung von Ämtern und Autoritäten (aus weltlicher und religiöser Perspektive) als auch der Umgang mit Rechten und Konflikten innerhalb der Stämme. Zweiter Teil dieser Arbeit bildet die Entwicklung Somalias von "Innen". Dabei wird auf die Zeit der Militärherrschaft, deren Entwicklung, Verlauf und Aufgang, von 1960 bis 1991 eingegangen. Der dritte Teil befasst sich mit den humanitären Interventionen während des Bürgerkrieges in den 90er Jahren des 20. Jahrhundert. Weiterhin wird die Entwicklung Somalias nach dem Abzug der UN-Truppen erläutert. Ein kritisches Fazit, wie auch ein Exkurs zur Wiederbelebung der "traditionellen Herrschaftsform in Somalia (siehe Kapitel 1) bildet den Abschluß. Zusätzlich finden sich in Anhang, zum besseren Verständniss der Arbeit, kurze Lebenläufe der wichtigsten Personen dieser Zeit, als auch nähere Erläuterungen zu bestimmten Partein und Vereinigungen aus dem politischen Leben Somalias.

Die Piraterie rückte durch eine Häufung von Übergriffen auf Handelsschiffe vor der Küste Somalias verstärkt in das Blickfeld der Staatengemeinschaft. Constitutionalism in Islamic Countries: Between Upheaval and Continuity examines the question of whether something similar to an "Islamic constitutionalism" has emerged out of the political and constitutional upheaval witnessed in many parts of North Africa, the Middle East, and Central and Southern Asia. In order to identify its defining features and to assess the challenges that Islamic constitutionalism poses to established concepts of constitutionalism, this book offers an integrated analysis of the complex frameworks in Islamic countries, drawing on the methods and insights of comparative constitutional law, Islamic law, international law and legal history. Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom – even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state – in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea’s long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done.
