It is a good moment to take stock of South Africa's progress in realising childrenʹs rights. To realise rights, the state needs to design and implement a range of measures which in clude strategic plans, policies, laws programmes, budgets and services. The Convention on the Rights of the Child (CRC), which was adopted unanimously by the United Nations General Assembly in 1989, marked a turning point in the perception of children in international law and policy. Although it was hoped that the Convention would have a significant and positive impact on the lives of all children, this has not happened in many parts of the world. This edited volume, based on empirical research and Non-Governmental Organisation project data, explores the progress of the Convention on the Rights of the Child, and to a lesser extent, the African Charter on the Rights and Welfare of the Child, in nine African countries in the 25 years since it was adopted by the UN General Assembly. The book considers the implementation of the Convention both in terms of policy and practice, and its impact on the lived experiences of children in societies across the continent, focusing on specific themes such as HIV/AIDS, education and disability, child labour, witchcraft stigmatisation, street children, parent-child relationships and child participation. The book breaks new ground in blending legal and social perspectives of the experiences of children, and identifies concrete ways forward for the better implementation of the CRC treaty in the various political contexts that exist in Africa.

This report is aimed at providing an overview of the situation of children in South Africa, with a focus on the non-fulfilment and violation of children's rights as formulated in the Convention on the Rights of the Child (CRC). The assessment utilises evidence drawn from available literature and interviews with key actors in the South African child rights arena. Based on the opinion of these key respondents, the report provides an overview of the key role players in the field, followed by suggestions for possible areas for intervention by international aid agencies. The assessment is limited by a number of elements, such as an extremely short time frame, the shortage of relevant information in certain areas, and the description of role players in the child rights arena is not comprehensive.

This book presents a comprehensive overview of African children’s lives in times of transition, transformation, and change some twenty-two years after political emancipation in South Africa. With diverse family formations, non-marital childbearing, and diverse parenting situations prevalent in South Africa, the book covers both the conceptual and theoretical questions that explore the context of children’s experiences. It uses examples from a range of primary and secondary data sources to illustrate how resilience in children faced with adversity could be nurtured, demonstrating the links between theory and practice, and critically commenting on questions of epistemology by drawing on research with children within different African social and cultural contexts. While the volume affirms the complexities of explaining child adversity or privilege, it stresses the diversity of South African children’s experiences and the importance of adopting both children’s rights and Afro-centric perspectives to account for the commonality and diversity of childhood and children’s empowerment in diverse family systems. The contributions also provide recommendations on how to respond and intervene in children’s issues, from both practical and policy levels, in a dedicated manner to ensure that children are protected from harm, nurtured to succeed, and assisted during and after traumatic experiences. This volume represents a valuable resource for scholars and students in the fields of humanities, social science, development studies and public health, as well as policy makers, child practitioners, and child rights advocates.

"The South African Child Gauge is produced annually by the Children's Institute, University of Cape to monitor government and civil society's progress towards realising children's rights. This issue focuses on children's citizenship and participation rights. The South African Child Gauge is divided into three parts: PART ONE: Children and law reform. Part one discusses recent legislative developments affecting children. This issue comments on the Births and Deaths Registration Amendment Act, Policy on Learner Attendance, Social Assistance Amendment Act, Basic Conditions of Employment Amendment Bill, Protection from Harassment Bill, and Prevention and Combating of Trafficking in Persons Bill. PART TWO: Children as citizens: Participating in social dialogue. Part two presents nine essays - the first two set the scene, defining children's rights to participate in decision-making and describing the conditions for children's meaningful participation in social dialogue. Four essays explore the challenges and benefits of children's participation in different contexts, from one-to-one encounters with professionals to involvement in democratic governance. The essays examine how to enhance children's relationships with professionals; strengthen their participation in school governance; facilitate their involvement in government policy and budget analysis; and support their active engagement with the media. Children's experiences of participation and the role of inter-generational dialogue in challenging and transforming how adults and children communicate with each other are also discussed. The concluding essay uses the notion of children as citizens to draw together key arguments and lessons. PART THREE: Children Count - the numbers. Part three updates a set of key indicators on children's socio-economic rights and provides commentary on the extent to which these rights have been realised. The indicators are a special subset selected from the website www.childrencount.ci.org.za" --Health Systems Trust website.

This collection is anchored in an African conception of children's rights and the law, and reflects contemporary discourses taking place in the region of the children's rights sphere. The majority of contributors are African and adopt an individual approach to their topic which reflects their first-hand experience. The book focuses on child rights issues which have particular resonance on the continent and the chapters span themes which are both broad and narrow, containing subject matter which is both theoretical and illuminated by practice. The book profiles recent developments and experiences in furthering children's legal rights in the African context, and distils from these future trends the specific role that the law can play in the African children's rights environment.
