Die brandenburgische Landesverfassung gewährt dem einzelnen Abgeordneten ein umfassendes Informationsrecht. Es schließt die Vorlage von Akten sowie den Zugang zu den Behörden und Dienststellen des Landes ein und geht über das traditionelle parlamentarische Fragerecht weit hinaus. Die so gestärkte Rechtsstellung der Abgeordneten verändert das Verhältnis von Regierung und Parlament. Die Arbeit behandelt die historischen und theoretischen Voraussetzungen und unternimmt eine funktionale Einordnung des Informationsrechts im Verhältnis zu anderen Verfassungsbestimmungen. Die verfassungspolitische Bedeutung erweiterter Informationsrechte wird erörtert. Hierbei werden auch die Parallelen zum allgemeinen Informationszugangsrecht des Bürgers dargestellt. Die durch den Gewaltenteilungsgrundsatz gezogenen Grenzen werden näher untersucht, wobei zwischen Regierung und Verwaltung differenziert wird. In Auseinandersetzung mit der verfassungsgerichtlichen Rechtsprechung, insbesondere zum Kernbereich der exekutiven Eigenverantwortung, wird die Grenze des Informationsrechts aufgrund einer funktionalen Betrachtungsweise bestimmt und dabei dem Schutz der Entscheidungsautonomie von Regierung und Verwaltung eine maßgebliche Bedeutung beigemessen. Die im Einzelfall erforderliche Abwägung wird anhand der unterschiedlichen Funktionsbedingungen von Regierung und Verwaltung näher dargelegt. Ferner werden die durch den Grundrechtsschutz bedingten Grenzen sowie Rechtsschutzfragen erörtert.

Democracies are in danger. Around the world, a rising wave of populist leaders threatens to erode the core structures of democratic self rule. In the United States, the election of Donald Trump marked a decisive turning point for many. What kind of president calls the news media the “enemy of the American people,” or sees a moral equivalence between violent neo-Nazi protesters in paramilitary formation and residents of a college town defending the racial and ethnic diversity of their homes? Yet, whatever our concerns about the current president, we can be assured that the Constitution offers safeguards to protect against lasting damage—or can we? How to Save a Constitutional Democracy mounts an urgent argument that we can no longer afford to be complacent. Drawing on a rich array of other countries’ experiences with democratic backsliding, Tom Ginsburg and Aziz Z. Huq show how constitutional rules can either hinder or hasten the decline of democratic institutions. The checks and balances of the federal government, a robust civil society and media, and individual rights—such as those enshrined in the First Amendment—do not necessarily succeed as bulwarks against democratic decline. Rather, Ginsburg and Huq contend, the sobering reality for the United States is that, to a much greater extent than is commonly realized, the Constitution’s design makes democratic erosion more, not less, likely. Its structural rigidity has had the unforeseen consequence of empowering the Supreme Court to fill in some details—often with doctrines that ultimately facilitate rather than inhibit the infringement of rights. Even the bright spots in the Constitution—the First Amendment, for example—may have perverse consequences in the hands of a deft communicator, who can degrade the public sphere by wielding hateful language that would be banned in many other democracies. But we—and the rest of the world—can do better. The authors conclude by laying out practical steps for how laws and constitutional design can play a more positive role in managing the risk of democratic decline.

Federalism has played a central role in charting educational progress in many countries. With an evolving balance between centralization and decentralization, federalism is designed to promote accountability standards without tempering regional and local preferences. Federalism facilitates negotiations both vertically between the central authority and local entities as well as horizontally among diverse interests. Innovative educational practices are often validated by a few local entities prior to scaling up to the national level. Because of the division of revenue sources between central authority and decentralized entities, federalism encourages a certain degree of fiscal competition at the local and regional level. The balance of centralization and decentralization also varies across institutional and policy domains, such as the legislative framework for education, drafting of curricula, benchmarking for accountability, accreditation, teacher training, and administrative responsibilities at the primary, secondary, and tertiary levels. Given these critical issues in federalism and education, this volume examines ongoing challenges and policy strategies in ten countries, namely Australia, Austria, Belgium, Canada, Germany, Italy, Spain, Switzerland, United Kingdom, and the United States. These chapters and the introductory overview aim to examine how countries with federal systems of government design, govern, finance, and assure quality in their educational systems spanning from early childhood to secondary school graduation. Was heißt Demokratie? Ist die EU demokratisch? Der Vertrag von Lissabon, der seit 1. Dezember 2009 in Kraft ist, gibt den nationalen Parlamenten erstmals eigene Rechte im Verfassungsgefüge der Europäischen Union. Nach Auffassung des Bundesverfassungsgerichts spielt der Deutsche Bundestag die entscheidende Rolle bei der Vermittlung demokratischer Legitimation. Doch wie wird diese Legitimation geschaffen? Sollten die Parlamente über eine eher »verhindernde« Rolle hinauswachsen und sich stärker gestaltend in den europäischen Politikprozess einbringen? Und bringt eine solche Beteiligung, wenn sie stattfindet, den gewünschten Effekt? Diese Arbeit untersucht die Rolle der nationalen Parlamente in den ersten fünf Jahren seit Inkrafttreten des Vertrags von Lissabon. Dabei werden zunächst die demokratietheoretischen Grundlagen beleuchtet und der europäische und deutsche Rechtsrahmen analysiert, bevor die tatsächliche Beteiligung der nationalen Parlamente in den Jahren 2010 bis 2013 näher untersucht wird.
