Amongst the oldest universities that of the Roman curia is the Great Unkown; little is known of the university of Rome (and of Avignon till 1378). To compensate the loss of sources materials mainly from the Vatican were intensively analysed and a prosopography of the dons and students (694 biograms in annex) drawn up. Some results: all three were legal universities of the southern type. The curial university was itinerant, it was continued at the general councils. Only when the curia resided there untroubled, the local schools of Rome (and Avignon) became great, international universities and different forms of association with the curial university were tried on. Rome was sought after by students from all over Europe for study of legal theory whereas praxis was learned at the papal court. Another attraction of Rome were the possibilities of attaining higher academic grades without much ceremony (first in theology, later also in law).

Communist East Germany's demolition of Leipzig's perfectly intact medieval University Church in May 1968 was an act decried as "cultural barbarism" across the two Germanies and beyond. Although overshadowed by the crackdown on Prague Spring mere weeks later, the willful destruction of this historic landmark on a central site symbolically renamed Karl Marx Square represents an essential turning point in the relationship between the Communist authorities and the people they claimed to serve. As the largest case of public protest in East German history between the 1953 Uprising and 1989 Revolution, this intimate local trauma exhibits the inner workings of a "dictatorial" system and exposes the often gray and overlapping lines between state and citizenry, which included both quiet and open resistance, passive and active collaboration. Through deep analysis of untapped periodicals and archives (including once-classified State documents, Stasi, and police records, and extensive private protest letters), it introduces a broad cast of characters who helped make the inconceivable possible, and restores the voices of not a few ordinary citizens of all stripes who dared in the name of culture, humanism, and civic pride to protest what they saw as an inconceivable tragedy. In this city that later started the 1989 October Revolution which ultimately triggered the fall of the Berlin Wall, residents from every social background desperately hoped to convince their leaders to step back from the brink. But as the dust cleared in 1968, they saw with all finality that their voices meant nothing, that the DDR was a sham democracy awash with utopian rhetoric that had no connection with their everyday lives. If Communism died in Prague in 1968, it had already died in Leipzig just weeks before, with repercussions that still haunt today's politics of memory.

Germany and the Holy Roman Empire offers a striking new interpretation of a crucial era in German and European history, from the great reforms of 1495-1500 to the dissolution of the Reich in 1806. Over two volumes, Joachim Whaley rejects the notion that this was a long period of decline, and shows instead how imperial institutions developed in response to the crises of the sixteenth and seventeenth centuries, notably the Reformation and Thirty Years War. The impact of international developments on the Reich is also examined. The first volume begins with an account of the reforms of the reign of Maximilian I and concludes with the Peace of Westphalia in 1648. It offers a new interpretation of the Reformation, the Peasants' War, the Schmalkaldic War and the Peace of Augsburg, and of the post-Reformation development of Protestantism and Catholicism. The German policy successfully resisted the ambitions of Charles V and the repeated onslaughtsof both the Ottomans and the French, and it remained stable in the face of the French religious wars and the Dutch Revolt. The volume concludes with an analysis of the Thirty Years War as an essentially German constitutional conflict, triggered by the problems of the Habsburg dynasty and prolonged by the interventions of foreign powers. The Peace of Westphalia, which ended the conflict, both reflected the development of the German polity since the late fifteenth century and created teh framework for its development over the next hundred and fifty years.

The Weimar Republic – from 1919 until 1933, when Hitler came into power – witnessed crucial debates on law and politics. These debates are reexamined in this book. Were, for example, democratic rules and procedures an adequate basis for democracy, as Hugo Preuss and Hans Kelsen suggested? Or should constitutional law elaborate the deeper, basic principles embedded in the democratic constitution itself, as Hermann Heller argued? Was the president the immediate “guardian of the constitution”, as Carl Schmitt’s concept of “representation” suggested? Or was Schmitt’s concept itself subject to Walter Benjamin’s critique of the aura of authenticity? These, and other typical Weimar-era debates helped shape West German constitutionalism. The former labor lawyer on the left Ernst Fraenkel, for example, began to develop a general theory of dictatorship mass democracy while in exile, which influenced the new discipline of political science after the war. Similarly, Gerhard Leibholz, an anti-positivist lawyer in Weimar, served on the first Constitutional Court of the Federal Republic of Germany, helping to consolidate its new constitutional culture.
