Die Wahlkapitulationen des Alten Reiches waren Dokumente, welche die Kurfürsten formulierten und zu deren Einhaltung die gewählten Kaiser sich vor ihrer Krönung verpflichten mussten. Den Staatsrechtlern der Frühen Neuzeit galten sie als »Quint-Essenz aller Reichsgesetze« und deutsche »Magna Charta«. Wolfgang Burgdorf zeigt, dass durch die Wahlkapitulationen seit 1519 viele Elemente in die Verfassung des Alten Reiches eingebracht wurden, die sich später auch in konstitutionellen Verfassungen finden, wie z. B. ein Grundrechtskatalog. Es ist daher gerechtfertigt, mit Bezug auf das Alte Reich von Protokonstitutionalismus zu sprechen.

Between 1793 and 1853 Columbia underwent a transition from being the Spanish viceroyalty New Granada to the Gran Columbia of liberator president Simón Bolívar, and on to become one of the most liberal republics in the contemporary world. The Constitutional Documents of Colombia and Panama 1793–1853 presents the first declaration of human rights in Spanish from the year 1793, along with the first constitutional charter of Ibero-America (that of the Free State of Socorro from 1810), as well as the previously little-known early constitutions of the Antioquia Republic from 1811. The volume contains 32 national documents and 21 state document of Colombia and two documents of Panama.

Se trató de la primera de las grandes transformaciones políticas que se originó en Europa, inclusive una relevancia particular de los experimentos visionarios en los Estados neo-europeos en las dos Américas. La teoría elaborada detecta una primera revolución parcial, enfocada en el crecimiento del poder y de la eficiencia gubernamental, que se distingue de la segunda revolución parcial, enfocada en el diseño sistémico y los valores públicos, creando el tipo ideal de la república constitucional democrática, social y ambiental. Evidentemente, las dos revoluciones parciales mostraron relaciones de tensión significativas entre sí. Saliendo del contexto originario en Occidente, Marquardt analiza la gran transculturación del planeta y la difusión mundial del nuevo tipo de Estado.
