Ein Recht auf Leben wird in Art. 2 Abs. 2 S. 1 GG gewährleistet. Daraus wird die staatliche Schutzpflicht, menschliches Leben vor Übergriffen Dritter zu schützen, abgeleitet. Verletzt der Staat eine ihm obliegende Schutzpflicht, kann die Nichtwahrnehmung der Schutzpflicht mithilfe der Verfassungsbeschwerde zum Bundesverfassungsgericht überprüft. Ein Problem ist indes, dass es als Folge der Verletzung des Rechts auf Leben zum Tod eines Grundrechtsträgers kommt. Die Verfassungsbeschwerde zielt zwar auf die Gewährleistung von Individualrechtsschutz, aber ist noch ein spezifisches Rechtsschutzmittel, um auch das objektive Verfassungsrecht zu wahren, auszulegen und fortzubilden. Wegen dieser Doppelfunktion der Verfassungsbeschwerde ist ein Rechtsschutzinteresse daher auch im Fall des Versterbens des Grundrechtsträgers zu bejahen, wenn eine Klärung verfassungsrechtlicher Fragen in einem konkreten Fall zu erwartet ist. Dazu werden Vertreter- und Prozessstandschaft-Lösung zur postmortalen Geltendmachung einer Schutzpflicht vor dem Bundesverfassungsgericht vorgeschlagen.
