Kulturell tief verwurzelte Anschauungen und religiose Traditionen sind beruhrt und nehmen auch in sakularen Staatswesen Einfluss auf die Debatte und ihre Ergebnisse. In diesem Band werden die Debatten um die Stammzellforschung in verschiedenen europaischen Landern untersucht, um den kulturellen und religiosen Pragekraften in der politischen Auseinandersetzung im Vergleich auf die Spur zu kommen. Neben Deutschland und Grossbritannien liegt der Schwerpunkt hier auf den ost- und sudosteuropaischen Landern (Polen, Tschechien, Rumanien, Turkei), deren Debattenlagen hierzulande weniger bekannt sind, aber auf europaischer Ebene zunehmend an Einfluss gewinnen durften."

Recent advances in techniques and understanding in the fields of genetics, embryology and reproductive biology have opened up new ways to treat a wide range of medical problems. They range from new options for infertility treatment and pre-implantation genetic diagnosis to stem-cell-based therapies for debilitating diseases. Since all these approaches involve the manipulation of human gametes, embryos or embryonic cells, and could also permit more contentious uses, they have stimulated a controversial debate as to what aims are desirable and to what extent experiments on human embryos are morally permissible, if permissible at all. The situation is further complicated by the fact that scientific projects are increasingly realized through international co-operation and that patients are increasingly ready to seek morally contentious medical treatment wherever it is available and thus to bypass national legislation. In view of this situation the Europäische Akademie assembled a temporary interdisciplinary project group in which scientists from universities and non-university research organizations in Europe working on the relevant subjects were brought together and charged with establishing a knowledge base and providing suggestions for long-term solutions that would be acceptable for society. Presented here are the results of this project, ranging from a discussion of the theoretical and practical possibilities in human-embryo experimentation and its alternatives in research on adult stem cells, a comparison of the situations and prospects of regulation of embryo research in Europe, a survey of European public attitudes, and a philosophical analysis of the arguments and argumentative strategies used in the debate.

Die Patentierbarkeit humaner pluripotenter Stammzellen war in jüngerer Vergangenheit wiederholt Gegenstand gerichtlicher Entscheidungen. Dabei stehen in Europa primär Fragen der ethischen Vertretbarkeit derartiger Patente im Fokus des Interesses. Demgegenüber wird eine entsprechende Diskussion in den USA unter anderen Vorzeichen geführt, wobei ökonomischen Erwägungen eine prägende Rolle zukommt. Mit Blick auf das europäische und US-amerikanische Patentsystem unterzieht Andreas Ruster die Bedeutung ethischer und ökonomischer Aspekte im Rahmen der Patentierung menschlicher Stammzellen einer kritischen Würdigung. Anhand eines gleichermaßen interdisziplinären wie rechtsvergleichenden Ansatzes entwickelt er einen Vorschlag zur Integration von Patentrecht, Ethik und Ökonomie, welcher auch über den Bereich der Stammzellpatente hinaus Denkanstöße liefern will.

In recent years the impact of human rights and fundamental rights on private law has risen in prominence and led to a whole series of detailed investigations. 'Constitutionalization of private law' is the flag under which most of the research on the increasing impact of national constitutional rights on national private legal orders is sailing. In the absence of a European Constitution, the constitutionalization of European private law suggests a process: constitutionalization instead of constituent power, demos, and the magic constitutional moment. The Charter of Fundamental Rights and the European Convention of Human Rights constitute the two pillars on which the transformation of European private law rests. This volume clearly demonstrates the change that has taken place, at the national and at the European level. Private law is no longer immune to the intrusion of fundamental and human rights. Whilst member states and the EU are driving the process by adopting ever more concrete and more comprehensive lists of human and fundamental rights, at the national, the European, and international level with overlapping contents, the true and key players in this development are the national and European courts. Contributions to this volume give this process a face and a direction, which is highlighted in the introduction by Hans-W. Micklitz.

English summary: Bioethical questions play a significant role, both nationally and internationally, in the public debate during the last decades. Not only, scientists but also the general public are involved in discussing bioethical questions. This phenomenon of a broad discussion applies especially to the topic of embryonic stem cell research. Within the framework of this bioethical debate, important constitutional rights such as, the protection of the human dignity, the freedom of scientific research, as well as the right to life and the physical integrity, have to be balanced off. The rising standard norm conflicts of the stem cell debate can be seen as exemplary for the bioethical norm conflicts in related debates concerning green gene techniques or the pre-implantation diagnosis. The present study examines the political communication process on the stem cell issue, as it has developed between the different social and political groups in Germany, since the turn of the millennium. Included in this work are the specific prerequisites of the German debate due to the German history and its history of ideas. Furthermore, the differences of the German debate to similar discussions in Italy, the UK, the U.S. and Israel are addressed. German description: Bioethische Fragestellungen spielen sowohl national als auch international eine uber Fachkreise hinausreichende bedeutende Rolle in der offentlichen Diskussion. Dies gilt nicht zuletzt fur die Problematik der embryonalen Stammzellforschung. Im Rahmen dieser bioethischen Debatte mussen hochrangige verfassungsrechtliche Normen wie der Schutz der Menschenwurde, der Forschungsfreiheit sowie das Recht auf Leben und auf korperliche Unversehrtheit miteinander in Einklang gebracht werden. Die vorliegende Studie untersucht den politischen Kommunikationsprozess uber die Stammzellproblematik, wie er sich zwischen den unterschiedlichen gesellschaftlichen Gruppen in Deutschland seit der Jahrtausendwende entwickelt hat. Einbezogen werden dabei die spezifischen historischen und ideengeschichtlichen Voraussetzungen der deutschen Debatte sowie die Differenzen zu vergleichbaren Diskussionen in Italien, Grossbritannien, den USA und Israel.
